The state Supreme Court on Wednesday agreed to hear a lawsuit by a lesbian against two fertility doctors who refused to artificially inseminate her on religious grounds.

Without comment, the court said it will hear the appeal by attorneys for Guadalupe T. Benitez, 34, of Oceanside in her lawsuit against Vista-based North Coast Women's Care Medical Group and Dr. Christine Brody and Dr. Douglas Fenton.

An appeals court ruled last year against Benitez, saying that the doctors could use religious freedom as a defense against her lawsuit. The doctors say their refusal was based on the fact that Benitez was unmarried, not because she's a lesbian.

If they don't want to help people because of their sexuality, then they shouldn't have started doing the job in the first place.

Yeah, why didn't she just go to city hall and get a marriage licesnce like all the other lesbians?

Could the doctor do something like that to a black couple? Whatever the standard is on that, the same standard should be applied. Unfortunately, I don't want to know how poor the standards are ... well I do ... but due to interest.

cause clearly, two women in a relationship isn't natural...but artificial insemination for couples who aren't naturally fertile is exactly how god and nature intended it!

If you're a health care provider i think you should expect to abandon your religious rights when you enter the office, since exercising them compromises patients much more essential personal rights.

I mean, imagine if a Christian Scientist or Jehovahs Witnes who happened to be an ER doctor was refusing to give blood transfusions because it goes against their religion? I don't think anyone would see that as a credible defense...but when its lesbian's reproductive rights lol, apparently those just aren't as serious as some religious wacko's feelings.

    Exactly.

Maybe this doctor and the pharmacists who refuse to dispense birth control because it's against their religious bigotry - whoops, beliefs - to do so might change their minds if they found themselves looking for a new job or inside a prison. These people should not be handling medical decisions any more than an insane person should.
