LimeWire, like other file sharing groups, is not liable for content transmitted, any more than your
internet provider itself would be liable if you transmitted illegal content. Likewise, UPS is not liable
if you were to send someone a package of illegal drugs through their delivery service.
A 1994 U.S. Supreme Court decision* absolves carriers of tangible goods and intangibles
(such as internet transmissions) from wrong-doing provided they do not know about the content.
For example, think of the great expense UPS would encounter if they had to rip open every
package they handled, looking for contraband. Likewise, LimeWire cannot possibly be expected
to analyze and police each and every bit traveling through their networks.
There is a lot of legitimate content on file sharing networks. For example, if I snap a photo of
my new car, I expect to be able to share the photo with my friends without the government looking
over my shoulder. Besides there is much material which is copyright-free. For LimeWire to be held
responsible for pirated content would be like expecting them to pick fly crap out of black pepper.
