Punishment should always be based on rehabilitation of the prisoner and when necessary protection of the public. Trying to use harsh punishments as a deterrent rarely works. Things like Capital and Corporal punishment should be absolutely banned.

I'd like to hear the views of members on what punishment is suitable for crimes committed in today's society and also what punishment would be deemed acceptable in a socialist and communist society ?
Many will argue that capitalism is the cause for many of today's criminal activity (but not all). That I can agree with, but how should such offenders be held accountable if they are near enough immune to prosecution because of their status, or because of a lenient sentence/'punishment' handed down by the judge on a convicted criminal ?

Yes rehabilitation should be the focal point of any offender, but i'm also of the opinion that certain crimes also deserve longer jail sentences. Vile acts such as sex offences should be treated with zero tolerance and a long stretch along with a rehab programme. Where i'm from its not uncommon for a rapist or a paedophile to get kneecapped, and honestly I don't be against such an action and neither has the various communities where this has occurred.
What about the crimes of the bankers who have caused destruction to our economy and who's disgraceful actions have oppressed the working class. How should we view these criminals and how should they be held accountable ?
Does 'direct action' or some sort of 'vigilante justice' have any relevance today ?
I don't believe in punishment. Rehabilitation is the word.
Punishment does not prevent "crime", nor does it "avenge" crime. It merely is an outlet for frustration.
Yes, much "crime" is only "crime" within society today. In a post-revolutionary society, most "crimes of property" (for example) will not be around.
As is said above, protection of the community at large is also important. For serial murderers and serial rapists, the community will definitely need a means of protection. How that occurs will depend on the community though. It is not for use to create blueprints and then force a future free society to obey them to the very letter or color of a panel on a wall.
The US has a epidemic of locking people up for petty crime DUI , drugs ,public intox, theft , shoplifting ,fraud.When poor person does shoplifting or fraud he or she goes to jail but rich person or business a slap on wrist.
Locking people up in jail does not deal with problem.Look at DUI and drug epidemic it has not stop people from doing it.The war should be war on poverty not locking people up or drug war.Well legalize drugs make them dirt cheap and if percentage turns to jukies and have major addiction problem and will not work but steal put them in rehab not jail or give them counseling.Make a war on poverty and all the need to steal ,theft , shoplifting ,fraud is gone.
Has for DUI take the car away from the person for a week and the next time sale the car than put the person in jail that does nothing.The putting people in jail for drugs or DUI has done nothing but put the US in hole and out of control prison/jail population.

In some cases they have to put people on the street before their time is up to make room for the next person.People sleeping on floor in the jail cell.The prison epidemic cannot keep up with this type of growth of locking people up do to a money problem very costly putting people in jail/prisom and space problem not to say safety.

Has anyone seen the documentary Capitalism: A Love Story Michael Moore? The part on the locking people up in jail/prison ? He goes on to say it is do to profit.The prison industrial complex.
I don't really think its a prison industrial complex or profit why we have a large prison population and a out of control population of people being locked up is do to profit or a prison industrial complex but a conservative problem. The conservative mentality where they have to be tough on crime even petty crime, the 3 strike law the tough on crime and war on vice drugs ,public intox ,public drinking ,sex, street hookers , DUI , public mischief , disorderly conduct so on.
The tough on crime and war on vice is why we have a out of control prision population .You go to jail for public intox or smoking pot and you do hard time .
It is a conservative mentality .

Well I believe foremost that the rule of law should supercede the rule of men. Socialist laws should be focused on eliminating external and internal threats to a more productive, happier, and moral order that it is sure of. For example, if "Life, Liberty, and the pursuit of property" were applied equally and within their full meaning (labor is property) then there wouldn't be as many problems in the USA as there are today or in the future.
Socialist legality failed in the USSR because of party discipline doctrines. Many corrupt officials were barred from facing the wrath of people because of these totalitarian implements. Anybody advocating party immunity from righteous persecution is an opportunist and should be purged from the movement.
