Separation of powers in a technocratic society

Given a recent debate with Dean, I would like to clarify one basic aspect of a technocratic society, and that is that it is only technocratic in relation to the means of production and the basis, namely technology, infrastructure, energy and resources.

Human beings, laws and forms of communities would be handled separately from the technate, by the human beings themselves. They would be given the opportunity to form their own communities with their own rules, as long as the rules conform to a basic code of human rights which would ban institution of cruel and harsh punishments, restriction of movement or religiously based laws regarding anything.
