Regulatory Document of the People's Council of RevLeft Marxist-Leninists
Enacted by the Provisional Central Committee of the Communist Party of RevLeft on July 16, 2013
Preamble
The People's Council of RevLeft Marxist-Leninists, established on the basis that all power among the Revleft Marxist-Leninists belongs to them and shall be wielded by them, constitutes itself as the sole legitimate force of state power of this community, upon which any higher organs of state power are accountable towards. The Regulatory Document has come into being to establish its abilities and to indeed regulate its work.
At a time when the security of the forum is endangered, and when the coherency of the Marxist-Leninists should be especially assured, the People's Council of RevLeft Marxist-Leninists also functions as the broad tribunal of this community, establishing consensus and representing all involved in the community who wish to be involved. The People's Council seeks to carry on its activities always in the service of the users and as fully accountable to them.
Chapter 1: Organization and Tasks
1. The People's Council of RevLeft Marxist-Leninists is the basic administrative organ of the RevLeft Marxist-Leninist community and its userbase.
2. The People's Council has an Executive Committee which is entrusted with managing the tasks of the Council when it is not in session, among other designated tasks.
3. The basis of the People's Council is that all power belongs to the masses and is wielded by them. It operates in the service of People's Democracy and the unity of the RevLeft Marxist-Leninists.
4. The People's Council has as its main task the supervising of any higher organs of state power and the drafting and confirming of laws which regulate activities and standards within the community.
5. The People's Council is in full opposition to the "ponies," their masters, and all other forces harmful to the community. It stands in solidarity with all forces for progress including the Blackhole. All higher and derived organs of state power also uphold these traits. The vanguard of the RevLeft Marxist-Leninists, the Communist Party of RevLeft, is the leading force operating in defense of the people's state power.
6. A meeting of the People's Council can be held when the amount of members listed as being in attendance is equal to or more than those absent.
7. A meeting may last for multiple days as multiple sessions, or through otherwise extended breaks to be decided by the Chairman of the Executive Committee or the Vice-Chairman, or by a vote of the Council itself when neither two figures are present.
8. At each meeting speeches may be made and laws and resolutions introduced, discussed and/or voted upon. Votes pass through a simple majority.
9. Meetings end only through the consent of the majority of the members present in addition to the consent of the Chairman of the Executive Committee or the Vice-Chairman, or by a member of the Executive Committee chosen by that body who represents either in the event of the absence of both.
10. During the voting process members of the Council and of its Executive Committee are completely equal. Absent members may vote through inferred or explicitly stated decisions decided by the members of the Executive Committee. Tied votes are decided by the Chairman’s decision.
11. Where the Council is not in session the Executive Committee is in continuous session, and has the power to introduce laws and resolutions on its behalf, provided they are achieved by unanimous vote within the Committee.
12. Any law(s) passed by the Executive Committee in between meetings of the People's Council must be voted upon by the Council at its next meeting or said law(s) will become null and void.
13. A meeting of the People's Council must be held exactly three months to the day any resolution or law is passed by its Executive Committee on its behalf.
14. No law passed by the People's Council can be annulled except through a vote to nullify said law(s) by a subsequent meeting or session of the Council, or where they are found to be in contradiction to the rules of the forum in which they preside as interpreted by joint decision of the Executive Committee and the forum administration.
15. The People's Council can, with a vote, establish additional institutions as it deems fit so long as these do not infringe on any higher organs of state power in existence.
16. The People's Council can vote to abolish itself with the consent of its Executive Committee and the approval of its Chairman, as well as with the approval of all higher organs of state power in existence.
17. The Chairman of the Executive Committee represents the People's Council of RevLeft Marxist-Leninists in relations with other state organs and to outside forces and organs, or the Vice-Chairman if the former is vacant or absent, or a representative of and from the Executive Committee chosen by the Council or appointed by the Chairman or Vice-Chairman.
18. No higher organ of state power may usurp or otherwise take control of any process of the People's Council and its competences.
19. No restrictions on discussion may be placed on the People's Council and its members.
20. This Regulatory Document may only be modified by a 2/3rd majority of votes in a meeting of the People's Council in which all members are present.
Chapter 2: Elections and Membership
1. Elections are held every year on May 5 or when called for by a majority and public vote of members of the community after five days of discussion within it, with the users themselves carrying out an election if their discussion is prematurely ended or otherwise manipulated. Any election called for must be held within two months. Neither the People's Council of RevLeft Marxist-Leninists or its Executive Committee may pass laws during the election process.
2. The election process is divided into three stages: nominations (15 days), voting (5 days) and the election day itself, which also counts as a voting day. Any election called for must therefore allow 20 days total for the whole electoral process. Anyone who has gained the support of the vanguard or existing social organizations of the users may become a candidate. The Executive Committee of the People's Council maintains a document listing recognized social organizations. This document can be modified by the joint consent of the Chairman and Vice-Chairman of the Executive Committee and the Chairman of the Democratic Anti-Brony Front.
3. The nominated candidates may contest a seat of their choice, of which there is a minimum of 20 available. A candidate cannot run for more than one seat. During the voting stage voters are presented with a slate or slates of candidates to which they can either vote to confirm or reject. If rejected the present composition of the People's Council is maintained.
4. The nomination and voting processes are regulated by an Electoral Commission which ceases to exist with the conclusion of the election. It is comprised of at least one delegate from the vanguard and from each existing social organization. Members have the days of the nomination period to decide on a Chairman and Vice-Chairman among themselves. If consensus is not achieved then a delegate from the vanguard in the Commission is chosen as Chairman and its Vice-Chairman is chosen by the leading organ of the vanguard.
5. The Electoral Commission during the nomination period confirms or denies candidacy status to anyone seeking it, either amongst themselves or by the decision of the Chairman or, if he or she is unavailable, the Vice-Chairman. During the voting period the Commission members and volunteers assisting them canvass for votes and report back to its Chairman on vote totals they have collected. Commission members may also serve as volunteers with the joint consent of its Chairman and Vice-Chairman. The Commission also sets how many seats there will be in the People's Council by majority vote within the first five days of the electoral process. If no agreement is reached on number of seats then the present amount of seats of the People's Assembly is retained. In setting the number of seats it abides by the minimum number noted in article 3.
6. At the conclusion of the election the Chairman of the Electoral Commission announces the vote totals that have been calculated and either confirms the results or calls for a recount, which extends the voting process another five days with all prior voters and their votes still being counted. If the subsequent voting is still considered insufficient or improperly conducted by the Chairman then the leading organs of the vanguard and any social organizations will have another five days to agree upon the allocation of nominated candidates to seats. If no consensus is reached then the election is cancelled and the present composition of the People's Council is maintained.
7. If the Chairman of the Electoral Commission is unavailable to carry out his or her activities then the Vice-Chairman assumes such powers for the duration of the electoral process.
8. In the event of a vacancy in a seat or no candidate contesting it then the Executive Committee of the People's Council can choose to appoints a user through majority vote within it, or to leave the seat vacant.
9. The composition of the People's Council and of its Executive Committee may vary, but the former must always have more members and not equal to or less than members in the latter.
10. No member of the People's Council may be removed except for inactivity, lack of interest, or good will in participating. The removal of said members is carried out during a meeting of the People's Council wherein all those present may hold a majority vote to remove said member with the consent of the Chairman of the Executive Committee.
11. The Executive Committee may face modification at a meeting of the People's Council upon request of the members of this Council who, in a majority vote, may remove certain members and add others so long as article 9 is respected. The Chairman and Vice-Chairman are likewise chosen and removed by members of the Council.
