payday in and payday out its the SAME SHIT!


we are supposed to get paid on the 1st and on the 15th of the month.
IF either falls on the weekend or on a holiday we have to wait extra days to get our checks.

The boss calls in our time cards to the payroll company and we are supposed to get paid the next day. so basically checks come in on the 2nd and on the 16th.

But they RARELY DO. because if they dont fall on a weekend or holiday. our Boss "forgets" to call them in and our checks are always 2 to 4 days late...

is this fucking legal? what can we do?

It depends, I know in my state paychecks can be late, but there is only a certain window of time after you're supposed to get paid. I would suggest reading the posters at your work place regarding such laws.

Most states have posting requirements and the federal government has some, too. You can see all of CA's requirements at: http://www.dir.ca.gov/WP.asp

An employer could face fines for not having the postings informing worker's of their rights.

Jesus! at my work, we don't have a single one of those posters!

also, the employees are the only ones who keep track of the hours they work. Is that legal? Also, we have a set date for payday (every other thursday) but we don't get a paycheck until we ask for it, my boss won't give it to us otherwise. Is that legal?

I have a pretty backwards workplace, as you can tell.


EDIT: also, why is this in DIY? shouldn't this be in Learning? or Practice at least?

theres no union for assistant audio engineers. we confronted the boss and he told us to deal with it.

In CA, your employer is obligated to keep payroll records. I think it depends on what state you live in. According to the CA DOL web site, it's a misdemeanor for your employer not to have the posting or pay you on your designated pay date. You're not even required to turn in a time card to get paid! See: http://www.dir.ca.gov/dlse/FAQ_Paydays.htm

CA has much tougher labor laws than where I live. In my state, I don't think it would necessarily be illegal for my employer to not keep records. It would be pretty stupid, but not illegal. Nevertheless, they enforce the laws here. If the DOL believes an employer has willfully violated the law, they can sue the employer on the employee's behalf.
