I download lots of mp3s from Myspace Music. They generally arent big name RIAA artists, because their music sucks; it's mostly foreign bands.
My question is- is it illegal and is there a major chance of getting caught?

I don't think its illegal. MySpace is owned by News Corp. one of the biggest media companies on earth, so I doubt they'd allow copyrights to be violated. Chances are the songs either arent copyrighted or the artists sign some sort of waiver to release it on MySpace. Therefore, no chance of getting caught since you didn't do anything catch-worthy.

Downloading MP3's from MySpace is 100% legal. The MP3s are actually posted on MySpace by the artists themselves.

ya it uhh... it couldnt be more legal. if they didnt want you to download it, they can make it not downloadable.

Myspace is owned by Rupert Murdoch's News Corp. It's not so much "so I doubt they'd allow copyrights to be violated" as "I doubt they'd allow themselves to be found guilty of violating copyright". It's therefore de facto legal.
