I don't get why Cuba can't just take the U.S. out of Guantanamo. how is this legal? i dont get the policies of this place and why the Cuban People allow the U.S. to hold a torture prision in their land

Guantanamo Bay is a huge military naval base. The US has a vast amount of military power close to Cuba. An invasion of the bay would be a perfect excuse for the US to obliterate Cuba.

Cuba and the US made a deal I think at least a century ago, that for $1000 a month the US rents out Guantanamo and this deal can only be broken if both countries agree. Castro has called for them to leave and refuses to take the $1000.

this makes them both hypocrates in my opinion. why wasn't guantanamo bay taken back around the revolution era? or during the cuban missile crisis when the USSR had their back?

the U.S. has the upper hand on Cuba then. they have the enem sleeping right there in their own backyard. they are ALREADY THERE! and been there. what the fuck? it makes no sense. the U.N. don't seem to care right?

Miami, Florida is closer to Havana than Guantanamo Base is. If Cuba were to kick the US out of Guantanamo then that sure would give the US a good excuse to invade Cuba and take it over.

The reason why the US has Guanatamo goes all the way back to the Spanish-American war. Remember, the Americans wanted the Spanish out of Cuba (but only so they could put a puppet-government in there).

it is based on an agreement from the last century, the previus gouverment.

This proves once more USA arrogance. This treaty lasts forever, covers quite a bit land. The rent is 1000$.

It is not valid, accordingly tominternagional law the treaty is illegal.

1. It was envoked during an period of american influence on cuba, wich removes its relyability.

2. when an agreement such as this is set with no expiartion date, the parts can pull out when they wish.

3. The US is breaking the agreement terms, it was for an naval base and for NO commercial use. <now we all know, it works as a prisonbase.
Alsoe it even is a MCdonalds there, breaching the no commercial use term

But what can Cuba do? give US an excuse to invade?

The US obtained Gitmo after the Spanish American War in the Platt Amendment (http://en.wikipedia.org/wiki/Platt_Amendment). According to it (it was passed in 1901) the base can return to Cuba when both countries can agree on it. Which won&#39;t happen with a socialist Cuban goverment. However, according to the article 52 of the 1969 Vienna Convention on the Law of Treaties (http://web.archive.org/web/20050208040137/http://www.un.org/law/ilc/texts/treatfra.htm):


A treaty is void if its conclusion has been procured by the threat or use of force in violation of the principles of international law embodied in the Charter of the United Nations.

Gitmo is an illegal base, but no one will enforce the law against the US.

During the Revolution, Cubans did steal arms from the base, and during this time Castro agreed to not touch the base, to pacify the U.S. for a time.

Remember, the U.S. holds one permanent seat on the security council and if ANY member on the council vetos any action, than it gets turned down.

So the U.N. is once again proved useless, it can only do what the U.S. will let it do. (or any country on the security council for that matter)
