UPDATE:
Sherman's sentencing under the plea will no longer be between 6-12 months, but instead 8-14 months due to a recent conviction which increased his criminal history category by 1 point. The government is suggesting 8 months in custody which will be 4 months in jail, and 4 months in a "community correction facility".
On February 27, 2003, Judge Williams accepted a Plea (FELONY 18 U.S.C. 842 (p)(2)(A): DISTRIBUTION OF INFORMATION RELATING TO EXPLOSIVES, DESTRUCTIVE DEVICES, AND WEAPONS OF MASS DESTRUCTION WITH THE INTENT THAT SUCH INFORMATION BE USED IN FURTHERANCE OF A FEDERAL CRIME OF VIOLENCE) with the sentencing range between 6-12 months. Austin's sentencing date is scheduled for June 30, 2003. However the Judge can withdraw from the plea anytime from now until June 30th if he chooses to. It is not yet certain how much time between the 6-12 months Austin will have to serve in jail/prison. The new plea was presented due to the fact that the original plea for 1 month in Jail, 5 months community confinement and 3 years supervised release was rejected by the Judge. If going to trial Austin faces a potential "Terrorism Enhancement" which can add an additional 22 years to his sentence.

the story is someone posting bomb making info on the site and he refused to remove it so he is being charged providing info for bomb making when he didnt put it on there. so much for what "freedom of speach" existed

I still think we are looking at this pretty one-sided.

The government associates terrorism with political ideologies like Anarchy. This is further reinforced by the site, and they are nervous about this information being availible to other "deviants" in a "deviant" area. Especially considering these things likely have to do with national security.

So who knows..... It was slightly self-inflicted because his, the creator of Rtf, morals prevented him from curtailing others "freedom of speech".

Yeah, I've heard about this. The FBI is constantly monitoring the site, they've hacked into files and all that. You have to expect this if you consider yourself a real revolutionary, the state will fight back no matter what.

While I don't agree with what the feds have done in this case, I can't say that it surprises me or that Austin wasn't stupid for doing what he did. All U$ residents have to be carefull in this post 9/11 era.

Ever since the passage of the Patriot Act and its recent expansion, we all have good cause to worry. Shit, if you hack a website (even if all you do is post nudy pics on GE's homepage) and perform "cyber-vandalism" you can be charged with treason which comes with the penalty of death upon conviction.

Not to mention my recent brush with a member of the intelligencia of our "beloved" country. I went drinking a few times with a guy who was both a contract agent for the CIA and NSA and a member of Air Force Intelligence. He was TDY on assignment in my hometown. After I told him I was registered to vote as SPF, he told me that he didn't want to talk politics with me because he liked me and he didn't want to put my name in a report to his superiors.

IMHO, Austin was asking for it.

he didnt want to delete it to keep free speech, RTF does not edit or deletes anyone posts. This was an attack on an individual which they have targeted in the past. Notice no charges have been brought against the person who actually posted the material. It is an attack on Sherman and RTF.

When you're for overthrow of the state, and you post how to make bombs guides, you are going to have to expect something. The State is our enemy, they will be merciless. They assassinated something like 30 or more Black Panthers...if he didn't expect something he's being naive.

Whatever. He wasn't even surprised when it happened, he expected something. He said "This is a war." The State is your enemy, don't expect them to play by yours or even their own rules. They will get you any way they can. A little side note: if you still think there is free speech in America, you are holding onto something that is not there.

anyway, just to clarify some things..

Was I "asking for it" by having that pathetic information on my site? Of course I was - we are all "asking for it" by attempting to stand up and speak out against this oppressive system. It's naive to think you can attempt to challenge this system and not have the state attack you for it. We are therefore "all asking for it" when we do things like come to this forum and type away as we call for revolution and the overthrow of the capitalist system. The FBI and many other government agencies have been monitoring raisethefist.com long before the "bomb making" information was even posted to it, and long before 9/11. These fools have been keeping a close eye on me and surevielling me for some very long time now. They simply used the U.S Patriot Act and the "bomb making information" as an excuse to come pop me. If it wasn't the "bomb making information" that did it, then it would have been something else. It was only a matter of time. I didn't author the information. Anyone who reads it and knows me personally will know after reading the first sentence that I didn't author any of it. Shit, I don't even know the first thing about explosives. All I did was link to the reclaim guide from the main page of the web site, which a small portion of delt with "defense weapons" and this was the page the "explosives information" was on.. Have any of you read it before? You can find mirrored copies on google. The person who wrote it pretty much ripped everything out of Steel This Book and the Anarchist Cook Book from what I hear. It's all common-knowledge bullshit from what I hear too.
Anyway, no I wasn't surprised when they came to my house with loaded sub machine guns and bullet proof vests. I even told them I wasn't surprised and I knew exactly why they were there (my website of course, duh). As I previously said, this is a war. I'm not going to sit here and complain that I'm being persecuted and how my "freedom of speech" is being "violated". OF COURSE IT'S BEING VIOLATED! It's been violated long before raisethefist.com! Our rights have been violated for the past 400 and 500 years! We should by now be used to the state attacking us every time we attempt to initiate revolutionary ideology into action. Nonetheless I think by now we should be better prepared as well. I'm in no way surprised about all the bullshit I've been through because of that web site. With struggle always comes sacrifice. When they all came to my house around 4PM in the afternoon, I was asleep in my room, unaware that 25+ feds with loaded weapons were surrounding the house. My sister was leaving at the time and noticed something didn't look right so she came back into the house to wake me up just before 2 federal agents ran to the door and unsuccessfully tried to stop her. She told me what the scenery was like outside so I got up half awake and went to the front door ..etc..etc. Since the incident I've been through so much shit you don't even want to know. The most important thing to realize I suppose is that I made my voice heard. And that was my #1 objective when I decided to make the site. So regardless of what these fed fuckers do to me now, I've still succeeded.

I went to court on June 30th for sentencing, expecting to get 4 months in jail, and 4 months in a "community corrections facility". The judge rejected this saying he was surprised that the prosecutors would agree to such a "light sentence for such a serious offense", and said he wanted to give me at least "8-10" months in jail, but first wanted to have the head Director of the FBI in Washington, DC consult the case and give a recommendation on sentencing before he makes his final decision.

So my sentencing date has been bumped to July 28th.

Anyway, what I am trying to say is expect political repression. Expect the state to try and smack you down. Don't complain if they do either. Instead become twice as strong every time they do and fight back twice as hard. If we are revolutionaries then we've got to act like it. We've got to exercise the revolutionary mentality; determination, discipline, self-defense, community, family, etc. Revolution is initiated by a course of direct action, meaning taking matters into our own hands. Revolutionary insurgency will always be met by violence and repression from the state. Always has and always will. The best thing we can do is to expect it, know it, study it, thus be better prepared for it, and fight back against it.

I don't know if running off to mexico would be the best thing. He wouild have trouble ever coming back if he needed to. and if he was caught on the way there couldn't he get more time for "evading" the law or something?

Anything is better than going to a prison. That in my opinion is cruel and unusual torture. Being brutalized in a prison over a website is obscene.

Yes, he may not be able to come back. So what. Like he's not going to be harrassed every day of his life now right? I'm sure the IRS will be watching him, the FBI and CIA will be watching him all the time.

Uhm, I think that is an abbreviation for the Socialist Party of Florida, although I might be wrong. This is just guess because he lives in Florida.
