JUNE 17, 2006

I. SUBJECT
In regards to Hartford delegate FRANCISCO L. ACEVEDO G. and criminal charges brought against him.

II. INTRODUCTION
Thursday, June 15th at approximately 11:35AM Comrade Francisco L. Acevedo G. of the Hartford Free People’s Movement Branch (HFPM) and the Central Committee of the Connecticut Free People’s Movement (CCCFPM) was stripped of his constitutional rights during an incident at Conard High School in West Hartford involving Resource Officer James Parizo of the West Hartford Police Department and another student. The incident occurred during a senior prank in which Acevedo began recording using his Kodak Digital Camera shortly after the 6th period class ended. While in the main lobby Parizo moved in front of Acevedo thus putting the camera focus on Parizo as he made his way through the crowded lobby. Parizo then was seen using what appeared to be excessive force on another student. The student shoved Parizo’s hand off his shoulder and then Parizo reached for his night stick but quickly put it away. Acevedo told Parizo "I've got you on tape. I'm videotaping this and you're using force on this kid. Chill out." Parizo then turned around and looked at Acevedo but then continued to shove the kid out of the crowd. At this point Dr. Irene Zytka in a loud and disruptive voice; that could be behind closed doors inside a courtyard next door, yelled at Acevedo to turn the camera off and to put it away. Acevedo then turned off the camera and put it away but replied to Zytka in the same tone of voice, "I have every right to record the police using force and it seemed like he was going to beat him up." Zytka then in the same tone of voice ordered Acevedo to go to the office adding that he never speak to her like that. Acevedo then headed towards the office questioning her “for what” several times in the same tone of voice as Zytka. While in the main office Acevedo was then told by Zytka to go to the vice principles office. When Acevedo made it to the vice principles office he was told the he was suspended and was to leave school grounds immediately. Parizo quickly in a loud voice informed Zytka that Acevedo was to stay to face arrest. Parizo made his way in the room and removed everything from Acevedo’s pockets. Parizo then in a loud tone of voice informed Acevedo that he was being charged with breach of peace, interfering with an officer and for inciting a riot which Parizo made clear the charge was a felony. Parizo then stormed out of the room. Acevedo took his phone and made several phone calls one of which was to a lawyer who then redirected him to Attorney Jon L. Schoenhorn. While speaking with Schoenhorn the school principal, A. Chuck Landroche and Zytka made their way into the office ordering Acevedo to put the phone away. Schoenhorn then told Acevedo to tell them he has every right to a lawyer and the directed Acevedo towards what steps to take. After the call Landroche informed Acevedo that he was suspended for a total of five days and that he was not to attend the graduation ceremony or the graduation party the following Wednesday. He then added that Acevedo was being disruptive, uncooperative, using curse words, and touching Parizo. When Acevedo tried to challenge the decision Landroche added that it was not up for debate. When they left Parizo demanded that Acevedo turn over the camera and the 256 MB memory chip. Parizo told Acevedo that he must have it to use against the other student and that the chip was evidence and that it was to be turned over immediately. Acevedo then handed over the chip. He was then told his rights and officially arrested. Parizo then informed Acevedo’s father of what happened including false information. Acevedo was handcuffed, taken to the police station in the back of a cruiser, fingerprinted and booked. Acevedo was held for approximately two hours before being released. The camera and the memory card remained confiscated.

III. ACTION TAKEN
The Central Committee of the Connecticut Free People’s Movement (CCCFPM) has insured that the following actions have been taken care of. Comrade Francisco L. Acevedo G. has contacted a lawyer and as of Thursday June 15th and as of June 16th sought a restraining order allowing Acevedo to graduate after the incident. In addition actions have been taken to get a judge to order West Hartford police not to tamper with or destroy Acevedo's digital camera and memory card. The case has been assigned to U.S. District Judge Stefan R. Underhill. There will be a telephone conference with both sides Monday morning. There have been contacts with several local organizations such as West Hartford Citizens for Peace and Justice, the Hartford C.L.A.S.H. Collective, Connecticut Students for a Democratic Society, Food Not Bombs and Latinos Contra La Guerra to meet on Tuesday at the Quaker Meeting House in West Hartford to discuss possible demonstrations to take place.
IV. COURT CASE

V. CONCLUSION
The following communiqué has been sent out for review to the National Committee of the United States Free People’s Movement and to be forwarded to all fellow comrades in respected branches in the United States. Further more we declare the communiqué public information open for any person to reproduce and redistribute its content. The incident that occurred the morning of June 15th was nothing more than a violation of Comrade Francisco L. Acevedo G. constitutional rights and a personal attack against his involvement in organizing a student lead walkout May 1st for pro-immigration rights. The Connecticut Free People’s Movement stands firmly beside our comrade and will do everything possible to make sure he can participate at his high school graduation and take the necessary actions against those responsible of wrong doing.
