I'm not the hugest fan of being lenient to those who break and enter, but it sounds like the above story is a perfect illustration of why it's a stupid idea to set potentially lethal boobytraps to defend one's home against intruders - such contraptions are non-discriminating, and it sounds like he didn't even lock the door in question, so someone with probably completely benign intentions got seriously injured.

These are illegal in every state. There are many potential problems with them, and Loknar, firefighters and police and paramedics should not have to concern themselves with whether or not the house they are entering will become their enemy.

Also, people who set such traps could get into accidents or die off site, and don't reveal what they've set up.

I am a traditional cappie when it comes to land: What one does with it must benefit their use or enjoyment of the land, otherwise, their conduct is subject ot legislation.

Hmmm, that does sound a little extreme, but it's basically the same thing as people in England who can't put barbed wire aroud vulnerable fences (homeowners), incase they injure a burglar. Pathetic yes ?

New legislation allowing 'reasonable force' has been passed, making everyone's life easier, and hopefully made harder the life of petty criminals.

Don't Americans have the right to defend their homes with firearms anyway ? (Poor understanding of the first amendment, someone do correct me)

i have no problem with people defendng there homes with reasonable force, killing is out of the question though if you end up killing someone you should be trailed for murder. well thats my view anyway.

The courts have ruled again and again, that giving ample warning to an illegal act is not an adequate defense for that illegal act.

"Hello, People of Los Angeles. Tomorrow I will rob the First National Bank at 11 a.m." does not absolve you of criminal or tort liability of those who intend to be inside of the bank at 11 a.m.

The courts have ruled that mantraps and deadfall traps that harm indiscriminatly, even on private property, are illegal, where the state has a statute against such traps or devices. All states have such prohibitions.

Ironically, you're defending a subject that commies and a majority of cappies oppose. Commies oppose it because the state, or local community, always has the final decision on land and its regulation and use. Cappies, because all 50 state legeslatures oppose such devices.

Then why is he being charged with assault? IF he should be charged with anything it is illegally booby trapping his house.

It also sounds like this guy has a history of being robbed. You cant rely on the police.

You did not read the story well. He is being charged with battery, which is a harmful touching.

Assault is the apprehension of such a touch, and there was no such apprehension in this case, as the touching happened before he could preceive the harm.

USUALLY, but not in this case, assault happens before a battery, so they combine them.

Sometimes there is only assault, when you are threatened, but not touched.

The only law in my reinforced compound is my law.. Call me all the macho idiots you want capitan but I'm armed to the teeth and have various rabid, attack animals at my disposal..

What's wrong with shrimp?
