I was thinking today that the whole gay and bizexual crowd should start a religion where being married to another of the same sex is required after a certain age. Then due to the 2nd ammendment I believe it is they would be allowed to be married if they were part of this religion. Worth a shot is it not?
Comments? Sorry if this is the wrong board but it really could go anywhere.

Hi.

First of all, it's the Free Exercise clause of the 1st Amendment which garuntees freedom of religion.

Second, here's the built in problem of your argument:
Homosexual marriage is not prohibited at the religious level of any of the 50 states. As you point out, that would be unconstitutional.

However, what you're asking for is for the religion to be recognized, which is contra to the 1st Amendment's Establishment clause. Kind of like saying, "My religion requires that I be given $500 a month from the state treasury: California, Snap to it!

Or, "I know I robbed that liquer store, but my religion prevents me from incarseration"

Or, "My religion allows me to have multiple wives."

Not to be mean, but this thread is D.O.A.

I'm implying no such thing. I'm stating as fact that the state can govern rules for marriage that do not take into account religious preference.

You can have 1,000 wives within your RELIGION.

But the STATE will only recognize ONE on file w/ a certificate in the county hall of records.

If you go to another jurisdiction and file a similar license, that's bigamy, illegal in all 50 states.

The vast majority of Americans and people throughout the world have a ceremony that satisfies both their religion AND the state and one and the same time, as the vast majority of people do not attempt bigamy.

You are mistaking Chirch doctrine for state action.

Yes, LDS, these days, has come out, officially, against polygamy. But I wasn't necessarily writing about Utah.

You CAN be married to 1,000 wives; you can create a group marriage that reads like Heinlein's Stranger In A Strange Land. You can do nearly anything you like, personally. Your marriage ceremony can involve 20 wives and 30 husbands, and declare, smack in the middle of Bererly Hills, that you are actually on Planet 10, and that all of this is within your religion and the state can do nothing about your declarations, or lifestyle, or calling each other "husbands and wives."

You can do all of this in Utah, or Hawaii, or Vermont.

But what you can't do is go to the county clerk and register your marriage with the state.

Why don't you understand this?
