- THE TRANSNATIONAL HAS LOST GM COURT CASE IN RUSSIA

Moscow Arbitrage Court rejected the suit of Nestle against All-Russian
Genetic Safety Association.

The Association blamed Nestle and other big baby food producers in using
GMOs in babyfood without labeling in June 2004. The reason for saying
this was the results of quantification analysis of baby food made by the
Russian lab Biokom in Moscow.

The results were the following:
"Frisosoy" soy protein for baby food (Friesland Nutrition, Netherlands)
50%
"Beby" soy and rice mix cereal (Kolinska, Slovenia) 100%
"Nestogen" dry milk mix (Nestle, Switzerland) 50%
"Alfare" nutritious dry mix (Nestle, Netherlands) 100%
"Tip-top", vegetable mix puree, (Nutricia, Poland-Netherlands) 20%
Puree "Vegetables with beef"(Nestle, Finland) 5%
Puree "Maize with potato" (Semper, Sweden) 100%
"Tutteli" dry milk mix (Valio, Finland) 100%
"Lamb" puree (Gerber, USA) 50%
"Beby" chocolate and hazel-nut cereal (Kolinska, Slovenia) 100%

(All figures mean a portion of GM content in soy ingredient).

When this information was publicized (June 3) all mentioned companies
with exception of Valio and Nutricia held a press conference (June 17)
where they claimed that never used GMOs in Russia and then the company
brought a reputation case against the Association saying that the
Association did not have a right to publish test results. It was a first
GM-case in Russia when a food giant was competing NGO, and it
fortunately had no success.

"We did not expect another decision on this case. Settle of a claim
would mean that everybody here in Russia is just a rightless consumer of
everything pushed into our mouths by TNCs. I do not want to think that
we live in a country where companies are in power to unceremoniously
develop their double standard policy" - said Victoria Kolesnikova, secretary of
the CIS Biosafety Alliance.
