SACRAMENTO, California (Reuters) -- California Gov. Arnold Schwarzenegger, who set up a tent outside his smoke-free state office to accommodate his taste for a good cigar, signed a bill Monday barring tobacco from state prisons.

The measure amends the state's penal code to bar tobacco products from prisons and youth correctional facilities. Violators are subject to a fine.

Supporters say the changes will help save the state money on health care and improve the health of 160,000 state inmates. Some parts of California's criminal justice system such as county jails have already banned smoking.

They might want to try and stop the flow of harder drugs in prison before they cut off cigarettes.

You know those war on drugs always work so well.

Well, they've banned it everywhere else in california - it seems a tad odd that those incarcerated by the states should have a right that 'free' people don't.

I do so love california - Airstrip Two if ever such a thing existed ;)

why would they restrict a flow of drugs in prisons? i'd rather profit of their addiction than have pissed off cold turkies fighting all the time!

Lets get this straight - is tobacco completely banned in prisons now? Does that mean that they can't even light up outside?

The ban on the use and sale of cigarettes, cigars, pipes, chewing tobacco and snuff takes effect July 1, 2005.


Inmate smoking is already prohibited at 13 of 32 adult facilities. The California Youth Authority has banned wards from smoking since the late 1980s. However, staff was permitted to smoke in designated areas.


There are two exceptions to the ban. Tobacco use will still be allowed in staff housing where there are no prisoners and at Indian religious ceremonies.

Nearly all county and city jails already prohibit the use of tobacco products

If they wanted to save money in the area of prisons there is about 20 diffrent things they would be able to do before they take away peoples cigarettes. I'm pretty sure you are still able to buy a person in prison with a carton of cigarettes, but don't take my word for it.

I mean if you wanted to cut to the direct sourse of prison costs, DON"T HAVE SO MANY PRISONERS FOR STUPID DRUG LAWS. Repeal the 3 strikes law, get rid of the death penalty (although considering the Governor's has played someone called the Terminator it doesn't seem likely).

But who is to say that the prison doctors really care about the the inmates health in the first place? In one case prison doctors refused for several years to provide a mammogram to an inmate who later died of complications from breast cancer.

"The state wound up paying a $350,000 settlement to [the inmate] before her death," Mountjoy said. "All of this the loss of life and the cost to the taxpayers could have been avoided if the prison system had simply provided adequate medical treatment."

As far as I know, people in california still get to smoke, just not in restaurants, offices, etc...

Prisoners don't really have anywhere to go, do they? This is rediculous and just plain cruel. If I was in prison, I'd probably smoke a few packs a day.

First it was the beaches, and now this. Yeah, pepole can still smoke out in public, just not indoors.

I don't understand why they would want to do that. They already have it hard in there as it is with all those messed up security gaurds.

If anything, those security gaurds should be considered more of a health hazard than the ciggarettes.

well, I like Arnold (his movies) and i know how much it sucks to have a smoking ban, being an ex smoker,(our school is hellua hardcore against smoking)
but this is just stupid, comeon arg, im not gunna say much coz there just isnt much to say, it's retarded

Actually, i don&#39;t think it&#39;s a really bad idea afterall (for health reasons), but it&#39;s a bit odd that he has such a longing for cigs but implement such measures for the prisoners. <_<

Holy shit, that is so fuckin retarded. People are such greedy assholes (pardon my french, but I live in Ca&#33;), because you know all this supposed "savings" will end up in someones pocket. California is going through such a huge economic crisis, where at my university, they&#39;re firing tons of people and cutting courses, and this is the bullshit he&#39;s passing? I mean, that&#39;s got to tell you where his prorities lie....first it was signing so illegal immigrants can&#39;t get licenses and now this. My gawd, I wanna beat ppl who voted for him with a bat...
