Okay, i need some help and this relates to my last similar post. My wife's job has been seriously fucking her over and while we are in the process of getting her enrolled in that union, i'm looking for some legal aid. She declined 2 pay raises with the promise that she would be given at least 5 'serving' shifts a week, she got two this week, meaning only two days worth of tips. Today she was held an hour late and was forced to do jobs that are NOT under her job description, and like i said, she was held an hour late and was told she would be fired should she not stay. This is absolute bullshit. Her boss has called our house leaving really nasty fucking messages the day after the hurricane cause she wasn't at work - OUR fucking roof collapsed, we had no electricity or water, and their were power lines in our parking lot. I'm just really really sick and tired of this shit and really need to find some legal aid since i cannot afford an attorney. Please help me out with this, i'll really appreciate it. Of the other things he has done:
Repedeatly scheduled her under 35 hours per week when she is listed as a fulltime employee.
He was literally talking shit about her and me to other employees several time. I was banned from the store for life because i told him quite flatly that he has no business as a manager to be discussing our personal lives or how he personally feels about us.
He purposely burnt an employee who used to work there.
He has had numerous customer and employee complaints filed with corporate offices.
Unfortunatly, the corporate offices refuse to take initiative so i will. Please email me at

Fuck legal aid. What you should do is exercise some judicious violence on this fucker. Collective violence is best in the capacity of a union but I see you have not had much headway in creating a strong union ... yet. At least do something to make his life a bit more miserable like emptying a five pound pack of sugar into his gas tank--- that should fuck up his car. Or sticking a potato up is muffler. Or poisoning his drink with some laxatives. I'd prefer to beat him to a pulp than to do some silly innocent shit like fucking his car up.

sounds like a bad situation. dont you have sort of civil claims firms in the US? in the UK we have some companies who take civil cases to court on a no-win no fee basis. and since if they do win the person being sued has to pay it works out almost free for you. you could see if there is anything like that available where you work?

First off, disreagrd everything that fucking idiot 2 posts above me said. I know that goes without saying, but I'm really saying this for him to hear. Sir, you're a fucking idiot, please go kill yourself.
Now, here's what I think you should do.
Invest every bit of spare cash you have to get a GOOD lawyer. Research it, don't just pick up the yellow pages. Find a lawyer that people have had good experiences with. SUE these motherfuckers for everything you can. What they are doing is HIGHLY illegal and has been ever since FDR was in office. They are fucking you in a way that most people haven't experienced in this country since the first half of the century.
First, if she was persuaded not to take a raise with a promise that she would be getting more shifts, that is illegal.
Second, keeping her late and then threatening to fire her is totally illegal. Eight hour workdays are the law !!
Third, listing her as full time when she isn't could be the one that really gets him. That should all be in the records and easily proveable.
Dude, go talk to a lawyer. I bet you can go talk to someone for free. See what they say, see if you've got a strong case. Hire a lawyer and get some fucking dignity back.
God I fucking hate this shit so bad. I've been through a similair situation. One example of it: When we work on state jobs we get what's called "prevailing wage". In Washington state that means 4 times what I make, $40 an hour. So, my boss tells me that I can either go to work and not get prevailing wage, or I can stay home and not work. Now, he says I can stay home and not work, but we all know that would be the end of me, I'd be fired (plus, keeping me home with no notice is illegal as well). So, he says if I do go, I'll get some of the money from the prevail wage in the form of a bonus. I agree because there is really nothing I can do. So, I go, we worked about 80 hours total on that job. I would've had at least a few grand in extra money. Well, a few months go by and I don't get shit, no bonus. I finally get some after asking at leat once a month. What do they give me ? $100. Out of about 3 fucking thousand dollars, I get 100.
Such is the life of a wage slave.

There should be some kind of non-profit organization that helps people in your kind of situation, I'm sorry but I don't know of any specifically, try searching the web (if you haven't already) Also, report the business to the better business bureau.

Another employees boyfriend actually kicked his ass right inside the restaurant while he was working and several customers gave an applause. The manager sued him for a very large sum of money and pressed criminal charges. I don't think i need to go there, especially not right now. I have too much shit in my life. Well, i just got back into town and thanks to the hurricane, i've worked 50 hours in the past 3 days, and have three more all-day shifts to go, and then a 1/2 day off.. yay! lol. Well, we've been searching for lawyers, and will try harder as soon as time allows. Thanks for all the help everyone, i appreciate it. We got a personal meeting with the top manager in the district next week, so hopefully we can do something, but regardless, i'm still pursuing this furthur.

Thanks for that link! I just called my fellow employees and we have agreed that this week we will "slowdown" production in order to get our raises. We currently make 7 dollars an hour. We work in a 140 degree kitchen doing VERY hard work. We intend to basically take our time and not rush at all, regardless of ticket times. We are also thinking about doubling up portions to fuck over management. I think i may be close to organizing a union at my own job.

I know the conditions in the USA concerning unions can be harder. It is however the way to go. How is the law concerning the right to unionise in the US?
