The Partnership for Civil Justice Fund has been busy! Some of our recent cases and victories are outlined below. "As people across the country are taking to the streets in peaceful mass assembly protest to register opposition to proposed government policies, the issue at stake here is defining for the breathing room democracy requires to survive," stated Mara Verheyden-Hilliard, Executive Director of the Partnership for Civil Justice Fund. "If people feel that they cannot join in peaceful protest without risking sudden mass arrest in the absence of any warning, it cuts the ground out from that which has been a central feature of American democracy. People must be able to gather together, stand up and speak out without being subject to abrupt criminalization of their First Amendment expression by police." The Partnership for Civil Justice Fund is proud to be part of the legal team litigating in federal court against the violent, militarized police suppression of Water Protectors at Standing Rock. The Water Protectors Legal Collective (WPLC) filed Dundon v. Kirchmeier, a federal civil rights class action lawsuit challenging law enforcement's excessive, indiscriminate and mass brutal force against Water Protectors. The Partnership for Civil Justice Fund has filed a lawsuit against the D.C. Metropolitan Police Department to obtain the release of documents regarding interim Chief Peter Newsham's handling of the January 20th protests against the incoming Trump Administration that involved mass arrests and indiscriminate use of force, including mass soaking with chemical weapons and stinger rounds. The DC MPD is standing in willful disobedience of its legal obligations including defiantly stating a refusal to disclose information where such information is mandated by law that it "shall be made available to the public on request." In March, 2014, a Laurel, MD, police officer pulled over Allan Sergeant in a CVS parking lot on a baseless traffic stop, ordered him out of his car, frisked and searched him twice and then, unbuckled his pants, pulled down his underwear and forced him to undergo a visual strip search in public view, while another police officer stood guard. There was evidence that Mr. Sergeant was subjected to this illegal, dehumanizing and terrorizing action because of his race and because he spoke with a Caribbean accent. "This is a major victory upholding fundamental civil rights and Mr. Sergeant represents all those whose voices are too often dismissed and silenced when they speak out against abuse of power," stated Mara Verheyden-Hilliard, Executive Director of the PCJF. The PCJF, partnering with the Washington Lawyers Committee for Civil Rights, litigated a federal civil rights lawsuit seeking justice for Mr. Sergeant which has now resulted in a $125,000 judgment in his favor.
