Kiarre Harris, Arrested For Parenting While Black

Dear Chris,

I just started a petition titled: 'Free The Children of Kiarre Harris. (https://act.colorofchange.org/go/7496?t=5&akid=7095.872082.dAxWPt)'

Here's why this is important:

In November of 2016, Kiarre Harris, an African-American single mother, chose to homeschool her children and remove them from a failing school in Buffalo, New York. Ms. Harris properly withdrew her children from the public school and fully complied with NYS regulations regarding homeschooling. The Buffalo Public Schools District notified Child Protective Services that the children were not attending school. Without the knowledge or notice to Ms. Harris, Child Protective Services secured a removal order from a Family Court Judge---based on educational neglect. When police first notified Ms. Harris of the removal order (which they did not provide a copy of), Ms. Harris refused to turn her children over to the police. She was arrested for obstruction.

Two days later, on January 18, 2017 the children of Ms. Harris were taken away from her and placed into foster care. An ongoing Family Court has now been triggered and Ms. Harris has been granted only limited supervised visitation of her two children.

This entire incident began with Ms. Harris' decision to homeschool her children and the Buffalo School District calling Child Protective Services with baseless allegations of educational neglect. Jailing a mother who has complied with the law; taking her children away, and subjecting the family to ongoing legal proceedings can not be allowed to happen. This sends a chilling message to parents who choose to fight for the betterment of their children's education. We need to make it clear: the policies and practices of the Erie County unit of Child Protective Services are racially discriminatory and adversely impact parents of poor and minority children. Kiarre Harris should be admired for doing all in her power to make sure her children have the best education possible.

Not trying to be an asshole or something. But if this is apparently so illegal and CPS is doing this intentionally to hurt a black person, then would the court not just throw it out and she could get a settlement which could buy her children a harvard education?
Again i don't know the situation judging from another continent. Is the law wrong, is CPS discriminatory or is the judge not impartial?

Well it's about the state's institutional racism and improper action-taking against her -- in other words New York State is holding Kiarre Harris to criteria that are not even its own, as far as I can tell.





State requirements[edit]

Some states do not require any notice of intent. Others require the filing of a notice with local school officials containing specified information. In conformity with the general trend to ease requirements however, only two states, Rhode Island and Massachusetts, still require parents to obtain approval prior to homeschooling. More stringent requirements even include the need to have a credentialed teacher supervise the homeschooled child's education.[citation needed]

Some states require homeschool students to be enrolled in public schools. Some states allow homeschool students to enroll in public schools but do not require them to do so. Some states prohibit homeschool students from enrolling in public schools.[3]

Proponents of heavier requirements[who?] argue that they are necessary for the societal goal of an educated public that is prepared to participate in democratic society. No scientific studies, however, indicate that heavier requirements produce better results. In general, standardized test scores in states with high requirements are no better than in states with lower requirements casting doubt on the wisdom of placing high requirements on homeschooling since higher requirements create higher administrative costs.[citation needed]

The 2013 Freedom in the 50 States study by the Mercatus Center ranks the fifty states by their homeschooling laws including: curriculum control, notification requirements, recordkeeping requirements, standardized testing, and teacher qualifications. The study finds states such as Alaska, Oklahoma, and Kansas as the freest states for homeschooling while ranking Ohio, Maryland, and Massachusetts at the bottom.
