Update: Potential New Arab and Muslim Ban

Washington, D.C. | www.adc.org (http://salsa3.salsalabs.com/dia/track.jsp?v=2&c=olBVANPxFFZP9lOnX7cSivX9%2BR2DWv5U) | February 22, 2017 - Reports indicate that Donald Trump will sign a new version of the Arab and Muslim Ban (http://salsa3.salsalabs.com/dia/track.jsp?v=2&c=wQaZ65BX%2F0E4Y5%2FrSWZkDPX9%2BR2DWv5U). The initial order, which was signed in late January, was met with much resistance and challenges. That order has been halted by the 9th Circuit Court of Appeals (http://salsa3.salsalabs.com/dia/track.jsp?v=2&c=605UCg5u748alUmLlA3LBfX9%2BR2DWv5U). Regardless of any changes Trump tries to make in his second order, the facts remain – this is an order discriminatorily barring individuals from entering the country based on their national origin and/or religion.

Additionally Trump has issued new enforcement policies (http://salsa3.salsalabs.com/dia/track.jsp?v=2&c=HbpLq2PqksMWxIUmIzSKQfX9%2BR2DWv5U) which drastically increase the number of ICE agents and radically expands those that are defined as a “priority” for deportation. Those policies will also expand expedited removal, which will remove individuals, including asylum seekers, without access to a judge. Collectively, the actions taken by Trump are tantamount to an attack on immigrants in this country. ADC will continue protecting the community by fighting and resisting these programs.

Breaking: A New Arab and Muslim Ban

March 6, 2017 | www.adc.org (http://salsa3.salsalabs.com/dia/track.jsp?v=2&c=9fS7fmYaQDSW%2FJow29kOUkSSSIyBVDeS) | Washington, D.C. – A few moments ago Donald Trump signed another Executive Order aimed at banning Arabs and Muslims (http://salsa3.salsalabs.com/dia/track.jsp?v=2&c=IIxCy0TUDGHNYBzf6JyF7USSSIyBVDeS) from entering the U.S. This EO was signed after his first attempt at the ban was stopped in court. The administration’s attempt to tailor the order so it conforms to court rulings does not take away from the fact that this is still and Arab and Muslim Ban. The new order is the same in nature as the old one. It prevents admission for nationals from six countries, Iran, Libya, Somalia, Sudan, Syria and Yemen. Further, the order puts a complete ban on refugees entering the U.S.

The new ban does have slight changes. Iraq has been removed from the list. (http://salsa3.salsalabs.com/dia/track.jsp?v=2&c=1QBmgPrOK2%2F2gER8Q%2B05p0SSSIyBVDeS) There will also be a phase-in period, with the ban taking full effect on March 16, 2017. The ban does not apply to lawful permanent residents (LPRs), and current visa holders. Additionally, ADC has been informed that the 60,000 visas which were revoked after the first ban was signed are now reinstated. ADC will be providing additional updates and information as they become available. This ban is not about national security; in fact the Department of Homeland Security issued a report indicating that the ban does not make America any safer (http://salsa3.salsalabs.com/dia/track.jsp?v=2&c=HHjKsYaNWx7bstqNyiuaNUSSSIyBVDeS). The ban is about xenophobia and Islamophobia. The new ban will have the same effect on our community as the initial one did, and ADC will continue to provide pro bono legal assistance to those impacted. Further, we will make ourselves readily available to come out to your city and provide sessions about the ban and its impact.

President Trump issued a new executive order today banning refugees. The order uses different words to accomplish the same thing the administration tried to do in January – close America’s doors to families fleeing violence and persecution.

Families like 5-year old Amena’s*, who fled Syria on a boat headed for Europe. Amena has a heart condition and asthma. During the trip on an overcrowded boat, her oxygen ran out. If a Save the Children rescue team hadn’t airlifted Amena to a hospital in Italy, she could have died.

No wonder families take desperate measures to escape the violence.

President Trump released a new executive order today banning refugees from coming to America. And he has also proposed massive cuts to the humanitarian assistance programs that help refugees like Amena and her family rebuild their lives. Muslim ban 2.0 is here.

On Monday morning, Donald Trump signed another Muslim ban. Shortly after the signing, he sent Rex Tillerson, Jeff Sessions and John Kelly to deliver prepared statements to the press. There were no cameras at the signing, and no questions at the press conference. The whole thing reeks of the cowardice and xenophobia we’ve come to expect at every turn from this administration.

Public outrage and the federal court system combined to create the perfect storm that forced the White House to revise its incompetent, racist and reckless original order. But the new order is just more of the same, and we cannot let it stand.

We must resist.

The revised order no longer targets green card holders or American citizens, but it is no less discriminatory or hateful than the original. It flies in the face of American values and ignores the basic facts and realities of America’s immigration policy and national security. It both suspends our refugee resettlement program and bans men, women and children from six majority-Muslim countries - Iran, Somalia, Sudan, Yemen, Syria and Libya - despite the fact that Trump’s own Department of Homeland Security recently reported that someone’s country of citizenship is not a reliable indicator of to whether or not they will commit acts of terrorism. 1

The 9th Circuit Court of Appeals explicitly rejected the Trump administration’s pleas to reinstate the original ban on the grounds of national security. Even the court system recognized that this ban does absolutely nothing to keep Americans safe.

Connecticut Sen. Chris Murphy is planning to revise and reintroduce legislation to “immediately overturn Trump’s hateful and dangerous executive order.”2 The first bill he introduced would withhold any funding to enforce the executive order and declare it illegal based on the Immigration and Nationality Act of 1965, which banned discrimination against immigrants on the basis of national origin.3 As long as immigrants, refugees and their families are under attack, we need to push our elected officials in Congress to fight back. They must reject any efforts to use xenophobia and racism to justify deportations, the suspension of civil rights or the closure of our borders. There is no room for a politics of hate and fear in our communities.

Nearly 270,000 CREDO activists joined people across the country to fight back against Trump’s first Muslim ban. Now we have to do it again. We must fight back against Trump and his racist administration’s xenophobic and illegal attempts to demonize Muslim and immigrant communities.

Speaking out publicly in massive numbers will show that we aren’t fooled by the Muslim ban 2.0 and will put pressure the craven and cowardly Republicans in Congress who have enabled Trump to date.
