Really interesting, i have been thinking of this recently. I am not sure either, some kind of collective action by the commune is necessary but i don't know if you are just making police with a other name then.

I see enforcement of the rules as a matter of equality. Everyone must have the same ability to enforce their rules; The problem with that being so many people; either everyone must obey the dictates of some polity that legislates what is right and wrong (Not Anarchy) Or everyone has the right to enforce their own law over their own polity; that is the politics of the free individual.

So how do you create a legal system where every individual makes their own law? Where one person does not have the ability to dictate judgement over others; where no one has a monopoly on authority.

The logical conclusion I believe is the line of consent. Every person must have the right to autonomy of the individual and the universal law then is simply the law of consent.
No property laws or rule by legislation; simply the law of Anarchy; destroying what destroys you.

What this means for policing is that everyone must police their own activity's; or suffer the consequences of their actions if they attempt to harm or exploit others.
Because without capitalist governments to protect exploitation and violence via nationalist law; everyone will be equal in the reality that is a system with no legal protections for those who harm others.
That is why the working class must be armed and organized; for if we are to establish a new system without class & inequality; everyone must be a part of maintaining order so that no one can form a class of armed enforcers who have a monopoly on violence (government)

All government is in the end is one class using violence against another.

Equality demands autonomy.

I think these are false options and the idea of autonomous individuals is a (usually right-wing) myth. we are pretty much defined by social interrelations--so the question is, how are these arranged.

Laws are unjust not because of some abstract "don't tread on me" bullshit but because they protect the ruling imbalance of power and wealth.

Mostly humans have policed themselves through custom and social pressure. A communist society likely would mostly operate that way but maybe some formal "rules" would exist for specific reasons... like stop at a stoplight because it's in all of our interests to not crash into each-other.


Edit: under a commune situation (or "worker's state") there would likely be the need for formal laws and enforcement at least temporarily and depending on circumstances. Workers would need to enforce their own rule for some amount of time (and probably directed at former official police who will not be on our side). This would be police by another name--but if a totally different composition and purpose and accountable to worker's power rather than capitalist beurocracies who in turn are accountable to local business power. This happened in Russia, Spain and the Paris commune (I think with the existing police in the commune which seems absurd to me).

But if there is no threat from fascists or elements of the old state or whatnot, there would be little need for a militia/police. Most "public safety" policing today is done through custom or ad hoc (people calm down a drunk at a bar) and this under shitty capitalist society where people don't trust eachother.
