Article 147 of the Fourth Geneva Convention defines war crimes as:

"Wilful killing, torture or inhuman treatment, including... wilfully causing great suffering or serious injury to body or health, unlawful deportation or transfer or unlawful confinement of a protected person, compelling a protected person to serve in the forces of a hostile power, or wilfully depriving a protected person of the rights of fair and regular trial, ...taking of hostages and extensive destruction and appropriation of property, not justified by military necessity and carried out unlawfully and wantonly."

This, international lawyers say, is the basic definition of war crimes.


Surely the USA has breached this during the Iraq war?

yeah.
u.s.a is always first one to blame other countries about war crimes,
and i'm sure u.s.a has break that convention!

Clearly a more obvious breach comes from the treatment of prisoners at Guantanamo bay. Here the U.S. is blatantly breaking the Geneva convention, appearing to show to the world how international laws do not apply to them, as they're just that great.

There excuse here is that "theyr'e not prisoners of war they're illegal combatants"

This is downright stupid, surely a 'war on terror' implies that captured terrorists will be Prisoners of war.

i think it shows how we shouldn t trust or hope for institutions set up by the bourgeoise such as the UN to help the working class and were as they were made to be, instruments of the ruling class

If that definition applies to Iraq, then it certainly also applies to every other conflict in human history. You would end up trying and executing the entire planet.

Let's remember, Saddam Hussein is the one who is going to be tried for war crimes, not George W. Bush, just like Slobodan Milosevic is being tried for war crimes and not Bill Clinton.
