He is one of four leaders of the local unjustly terminated last October after the company locked the drivers out for demanding a meeting with the company on 18 unfair labor practices. The false charges against him stem from conducting a union meeting to brief members on contract negotiations on the day the old contract expired, union activity specifically allowed by the collective bargaining agreement.

COURT CONSIDERS THREAT ON FACEBOOK 'PICKET LINE' -- Judges on the country's second most powerful appeals court were divided yesterday over whether threats made on a union's private Facebook page were distinguishable, in the eyes of the law, from threats made on a real-world picket line.

A three-judge panel of the D.C. Circuit heard oral arguments in Charles Weigand v. NLRB. Weigand, a non-union employee of Veolia Transportation Services, claims that in the run-up to a six-day strike in 2012 he was threatened by members of the Amalgamated Transit Union on ATU's Facebook page. Weigand did not have access to the private page, but eventually he learned that union members had said on the Facebook page that they would picket the houses of strikebreakers.

The NLRB previously affirmed an administrative law judge's ruling declining to find the union liable for the alleged threats, on the grounds that a private Facebook page was not analogous to a picket line. Under the National Labor Relations Act unions can be held responsible for any coercive acts their members engage in on a public picket line. Weigand appealed this decision.

At yesterday's oral arguments, Judge Brett Kavanaugh, a Republican appointee, seemed more sympathetic to Weigand's argument. "I'm having trouble guessing why threats on a Facebook page are different analytically than threats on a picket line," Kavanaugh said. But Judge Harry Edwards, a Democratic appointee, found Weigand's argument a stretch. "You'd definitely have a different case if it's publicly accessible," Edwards said. The campaign to rehire four Boston school bus drivers, illegally fired by the union-busting Veolia Corporation, got a shot in the arm on Thursday when a jury took only ten minutes to acquit union leader Steve Kirschbaum of all charges brought by the Commonwealth of Massachusetts.

The ten-minute verdict was the result of an eight-month peoples’ mobilization that included six pack-the-court rallies; national call-in days to both the district attorney and the mayor; and weekly busyard rallies organized by the local. Peoples’ lawyers Barry Wilson and John Pavlos skillfully and passionately tore the frame-up apart and successfully turned the tables, putting the union-busters on trial.

School bus drivers and community supporters of the union packed the court for three days, transforming the inside of the courthouse into a de facto union hall. During lunch breaks the drivers held militant picket lines outside the building, with placards saying “Drop the Charges” and “No Contract, No Work”!

Dorchester District Courthouse became ground zero for the political movement, as Brock Satter with the Mass Mobilization Against Police Violence, as well as Sandra Macintosh of the Coalition for Equal Quality Education and former City Councilmember Chuck Turner all showed up to support the union. City Councilmember Charles Yancey gave updates to the overflow crowd outside the courtroom, and for two of the three trial days, I-93 protester Tsung attended.

Herculano Fecteau of the Boston Teachers Union showed up, as did Tony Van Der Meer of the Africana Studies Department at UMass. The verdict was a victory not only for this political, social union – which not only fights for its members but marches with the Black Lives Matter movement, resolutely defends LGBTQ rights and marches for Palestine – but a victory for the movement as well.

And it was a defeat for the union-busters, Boston’s 1%, and the city’s entrenched racist forces who want to re-segregate public education.

From the moment the four bogus charges were filed against Kirschbaum in July 2014, it was clear that they were part of the union-busting campaign being waged against the local – a campaign that included the November 2013 firing of Kirschbaum as well as three other union leaders.

When a June 30, 2014 rally of hundreds of school bus drivers – held to demand the rehiring of the four — ended with an indoor rally in the drivers’ breakroom, Veolia managers provided false statements to the Commonwealth to make it look like they had been attacked by Kirschbaum and that the premises had been violently entered.

The charges were totally made-up but serious: three were felonies, initially including breaking and entering to commit a felony; malicious destruction of property; assault and battery with a dangerous weapon; and trespassing.

The evidence was so obviously manufactured that in October the first two charges were dismissed by the judge. On Thursday, a working class jury of six – including two union members — “dismissed” the remaining two charges with a not-guilty verdict in record time.

In fact, it was Veolia and its co-conspirators who were put on trial as witness testimony and Kirschbaum’s legal team showed that the events in question had everything to do with the fact that the contract was expiring that day at midnight – and that, in violation of the contract, Veolia had attempted to prevent the union from holding a meeting.

In October 2013, the notorious union-busting company fired four of the union leaders – including Grievance Chair Kirschbaum, Recording Secretary Andre Francois, Steward Garry Murchison and Vice President Steve Gillis – after locking out the workers and falsely claiming that the union had conducted a “wildcat strike.”

The not-guilty verdict — which has so thoroughly discredited the version of events put forward by Veolia managers — can only help the campaign to rehire the four. Those in the Boston establishment who were holding their breath over this trial and hoping to see one of the union’s leaders convicted are now facing a renewed, fighting union that is not afraid to take things to the next level.

Those who know this local also know that its members intend to fight not only to rehire the four but to deepen the Black Lives Matter movement and the struggle against racism; stop the school closings announced by Mayor Walsh; defend public school transportation by keeping middle school students off the subway and on school buses; and defend the righteous I-93 protesters and their First Amendment rights.

We are writing to ask for your support and solidarity in a most critical battle against the Veolia corporation’s union busting war on USW Local 8751. It is a vital fight to protect union rights and defend the fired leaders of Boston School Bus Union, USW 8751 - Vice President and Pension Administrator Steven Gillis; Recording Secretary and Charlestown Chief Steward Andre Francois; Steward and former 3-term president Garry Murchison; and Grievance Chair and founding member Stevan Kirschbaum. Veolia, a French based global conglomerate, has a trail of union busting and corporate ruthlessness around the world. Veolia businesses include transportation, energy, environmental, water and more. In transportation alone, Veolia has waged anti-union campaigns against bus drivers from San Francisco (SEIU 1021 and ATU 1555) to Phoenix (ATU 1433); from Pensacola (ATU 1395) to Las Vegas (ATU 1637); and from Baltimore (UFCW 1994) to Denver (CWA 7777). Veolia’s standard tactics are to low bid city management contracts, then force concessions and cutbacks in clear violation of the existing union contracts. When the workers and their unions resist, they threaten, harass, discipline and fire the union leaders and activists.

Despite signing an agreement to honor all terms and conditions of the USW 8751 contract on June 18, 2013, since Veolia took over management of the Boston School Bus transportation on July 1, 2013, they blatantly and systematically violated nearly every article regarding wages, benefits and working conditions. At the same time, they repudiated the established grievance and arbitration procedures. Since July 2013, the union has filed hundreds of individual and class action grievances. In August, the Steelworkers filed 18 Unfair Labor Practices charges with the National Labor Relations Board. On October 7th the company attempted to force the drivers to fill out new hire applications. The members also knew that due to the Federal Government shutdown at the time, they had no redress available. This was the straw that broke the camel’s back.

On the morning of October 8th the drivers reported to work and demanded a meeting with Veolia, whose top management as well as BPS officials were on site at the bus yards, concerning the company’s total failure to honor the contract. They refused for hours; then at 11:00 am, the company locked the gates and evicted the drivers under threat of arrest for trespassing. The workers’ request for a meeting is protected concerted union activity, and the company’s lockout was not only a violation of the contract but of federal law. There never was a wild cat strike. This allegation was a cruel hoax perpetrated against the Union by Veolia, with the aid of former Mayor Menino and his School Department and the Boston media. When Boston City Council called a hearing to investigate the events of October the 8th,Veolia, the Menino’s administration and Boston Public School officials boycotted. The City Council has vowed to continue the investigation. Veolia, in a clear attack on the organizational backbone of the union, singled out the four union leaders for firing. They have been out since the first week of November 2013.

Meanwhile BPS has initiated a massive austerity cutback campaign that calls for kicking middle school students off the yellow school bus as well as reduction in union staff and services throughout the system which will not only jeopardize equal quality education but will eliminate union jobs!

For over 40 years Barry has set the standard for passionate, determined, “no holds barred” advocacy in defense of his clients. Barry’s formidable skill set, scholarly command of the law, boundless creativity and singular courtroom presence has earned him the love and admiration of his clients and colleague.

It has also earned him the hatred of the forces of oppression, racism, sexism, discrimination and injustice both in and out of government and the courtroom.

His client list has included Boston City Councilor Chuck Turner, the “Plymouth 25 (National Day of Mourning), Amer Jubran (Palestinian activist), Marcus Jean (Haitian unionist), and countless movement protestors victimized by the police.

He was the first lawyer for the militant Boston School Bus Union at the time of its formation in the 1970’s and provided exemplary legal solidarity with USW 8751 militants throughout the years including his current defense of USW 8751 founder and Grievance Chair, Steve Kirschbaum against anti-union frame up felony charges.

For 40 years Barry has stood with us, it’s time for us to stand with him!

The breakout of struggle in Baltimore shows yet again: capitalism has no answer to the crisis it creates on a daily basis.

Even before the death of Freddie Grey, the Black Lives Matter movement had of necessity re-ignited -- this time with a May 1 work stoppage announced by the militant longshore workers union in San Francisco as well as a pledge by the South Carolina AFL-CIO to use that day to protest police killings.

On April 18 in Boston, the sound stage for Boston's first major spring protest against racist police killings was provided by USW Local 8751, the School Bus Drivers Union.

This righteous, fighting union, one of the first back in December to formally endorse and make a $1,000 donation to the struggle against police brutality in Boston, is still in the streets with the people -- even with four of its leaders fired by the union-busting monster Veolia Corporation.

On April 30, 2015, the militant, fighting rank & file of USW 8751 demonstrated a powerful electoral mandate on Amnesty. The Team Solidarity Executive Board Election 2015 slate, led by the four illegally fired leaders, scored a stunning victory, capturing ALL positions by an unprecedented landslide. In the largest voter turnout in the history of the Local, the membership sent a message, loud and clear, to Veolia/Transdev, Boston Public Schools, and Mayor Walsh, that USW 8751 is prepared to fight and win a just contract with reinstatement of the 4 fired leaders and to unite with the community to struggle for equal quality education!

Veolia, a French based global conglomerate, has a trail of union busting and corporate ruthlessness around the world. Veolia businesses include privatizing transportation, energy, environmental services, water and more. In transportation alone, Veolia has waged anti-union campaigns against bus drivers from San Francisco (SEIU 1021 and ATU 1555) to Phoenix (ATU 1433); from Pensacola (ATU 1395) to Las Vegas (ATU 1637); and from Baltimore (UFCW 1994) to Denver (CWA 7777) to Seattle (ATU 587). Veolia’s standard tactics are to low bid city management contracts, then force concessions and cutbacks from the workers in clear violation of the existing union contracts, and service cutbacks and rate hikes from communities. When the workers and their unions resist, they threaten, harass, discipline and fire the union leaders and activists.

Despite signing an agreement to honor all terms and conditions of the USW 8751 contract on June 18, 2013, since Veolia took over management of the Boston School Bus transportation on July 1, 2013, they blatantly and systematically violated nearly every article regarding wages, benefits and working conditions. At the same time, they repudiated the established grievance and arbitration procedures. From July to June, the union has filed hundreds of individual and class action grievances. In August, the Steelworkers filed 18 Unfair Labor Practices charges with the National Labor Relations Board. On October 7th the company attempted to force the drivers to fill out new hire applications. The members also knew that due to the Federal Government shutdown at the time, they had no redress available. This was the straw that broke the camel’s back.

On the morning of October 8th the drivers reported to work and demanded a meeting with Veolia - whose top management as well as BPS / Menino officials were, for the first time ever, on site at the bus yards at 5:00 AM - concerning the company’s total failure to honor the contract. They refused for hours; then they called in the police, and at 11:00 am, the company locked the gates and evicted the drivers and City Councilor Charles Yancey under threat of arrest for trespassing. The workers’ request for a meeting was legally protected concerted union activity, and the company’s lockout was not only a violation of the contract but of federal law. There never was a wild cat strike. This allegation was a cruel hoax perpetrated against the Union by Veolia, with the aid of former Mayor Menino and his School Department and the Boston media. When Boston City Council called a hearing to investigate the events of October 8, 2013, Veolia, the Menino’s administration and Boston Public School officials boycotted. The City Council has vowed to continue the investigation. Veolia, in a clear attack on the organizational backbone of the union, singled out the four union leaders for firing. They have been out since the first week of November 2013.

Meanwhile BPS has initiated a massive budget cutting campaign that calls for closing schools and more privatization, cutting back summer programs for at risk youth, kicking middle school students off the yellow school bus, as well as reductions in union staff and services throughout the system. These austerity attacks will not only jeopardize equal quality education but will eliminate good union jobs in our communities!

Take Action at crucial juncture to reinstate USW 8751 union leaders

The long battle of the militant, mostly immigrant rank and file of USW 8751, the Boston School Bus Union, to STOP Veolia Corp's union busting, reinstate the four union leaders unjustly fired 19 months ago and win a just contract for the drivers and safety for the school children of Boston has reached a crucial juncture, requiring an extra push of solidarity and support from all of us.

The union's momentum is at an all time high following Team Solidarity's clean sweep of the Executive Board elections, with the four fired leaders elected to the president, vice president, financial secretary and grievance committee positions, and all other elected positions going to Team Solidarity members, in the local's highest ever voter turnout.

The election victory followed the stunning victory in court in March, in which it only took the working-class jury ten-minutes to find Vice President-elect Stevan Kirschbaum not guilty of all of the bogus trumped up felony charges Veolia and the Boston Police had attempted to throw at him. Together these victories have resulted in a decisive, qualitative shift in support from the international, and increased pressure on Boston Mayor Walsh to rehire the four wrongfully fired leaders..

Our task is to keep that pressure on. The current period is critical because we know that Walsh is feeling the heat and there is momentum from the election victory. He is feeling the heat from our phone calls as well as calls from hundreds of school bus drivers demanding that he re-hire the four -- as well as pressure from the international union, plus communications with leaders in Boston's African American community.

At the same time, the mayor is under pressure from "the Vault," the Boston 1%, to keep the reds out of the union, and to keep the union from its militant work in the struggle against racism citywide -- whether it's the struggle against police terror or fighting resegregation.
What we do in this period could be decisive. So, we are asking supporters to do the 4 steps below and call five people they know and ask them to also take these steps:

1) Call Mayor Walsh's office and demand that he order Veolia to re-hire the four. Continue to call the mayor's hotline number at 617-635-4500. ALSO call the Mayor's "policy office" -- it's 617-635-1414. And KEEP CALLING!

Like many union struggles, the Boston school bus driver fight has been a long one.
Four of the union’s leaders were unjustly and illegally fired by the union-busting Veolia Corp in November 2013—and still haven’t gotten their jobs back.

The company they are up against, recently renamed Transdev, is not only notorious for union-busting—which is bad enough—but Transdev supports Israeli apartheid by operating segregated rail lines in the occupied West Bank.

But unlike many protracted union struggles, this union—Steelworkers Local 8751, with a majority immigrant workforce of Haitian, Cape Verdean as well as African American workers—has won a series of stunning victories in its fight for justice.

The first one came in early March, when a transparent union-busting attempt by Veolia to frame union Vice President Steve Kirschbaum with a series of false felony charges was crushed. A working class jury returned a not-guilty verdict in a record ten minutes.

That was round one. Round two came when, in the union’s highest-ever election turnout, the members voted in the full slate of Team Solidarity candidates—led by the fired leaders!—by a landslide to the union’s Executive Board.

One could compare this righteous upset to socialist labor leader Eugene Debs getting a million votes for U.S. president while in jail for opposing World War 1. As sweet as this second victory was, the members know that the third and final battle has not been won: the reinstatement of the four.

Veolia has gone even further in its attempts to break this mighty union. To give just one example, they illegally issued an ultimatum, with threats to eliminate a million dollars in retroactive pay raises, if the workers do not accept a concession-laden “last best offer” to replace the contract that expired June of last year. Not only is Veolia trying to starve out the four, the company is using every trick in the book to create a division between them and the membership as contract negotiations drag on.

Veolia has yet again underestimated the united resolve of this class-conscious, militant union, whose members march with the Black Lives Matter and LGBTQ movement. But the four do need help to continue this fight. This isn’t the typical case of a strike where the union has a strike fund—though a strike may well be coming. The four fired drivers, out of work 22 months, are relying on solidarity donations to support themselves and their families while they fight for their jobs and perform their duties as elected union leaders.
