The decision will rely on the artificial distinction between public and "private" (corporate) property.
These right wing idiots that the alternative to representation is not compliance, but violence. Right now the mechanisms of labor disputes are ritualized into a legal system. Once that becomes unusable, workers will go from ritualized coercion to actual coercion. Instead of a closed shop, a non-union worker will get his legs broken. I'm not advocating this course of action, of course, but see it as inevitable.
