A Yellowstone County district judge Monday ordered a former Senior High teacher convicted of raping a 14-year-old female student who later committed suicide to spend 30 days in jail. Judge G. Todd Baugh sentenced Stacey Dean Rambold to 15 years in prison, with all but 31 days suspended, for sexual intercourse without consent. Rambold, 54, will be given credit for one day already served. He was handcuffed and led to jail at the close of the hearing.

The judge's sentence was not received well by the girl's mother, who repeatedly screamed "You people suck!" and stormed out of the courtroom. Auliea Hanlon testified earlier at the hearing that her daughter's relationship with Rambold was a "major factor" in her suicide, and she begged the judge to order Rambold to prison.

Rambold had a "deferred prosecution agreement" with prosecutors that barred him from having contact with minors and required him to complete a sex offender treatment program. But Rambold got kicked out of that sex offender program and had contact with minors. More appalling details here—including the judge's contention that Rambold's victim was "older than her chronological age," and Rambold's lawer's contention that his not raped, not dead client is the real victim because he has to wear the "scarlet letter of the Internet."

First of all, this judge shouldn't care how old that girl was but THAT SHE WAS RAPED and that it was by HER TEACHER. Rape means no consent so who gives a fuck how old she was?!

How does someone get sentenced then have it suspended? That I don't understand. Can someone explain it?

i think that idiot elected judges like in the OP are the perfect argument AGAINST the death penalty within bourgeois law, lets keep "hang the rapist" chest thumping for another thread and keep our attention and anger foccused on the deeply fucked up judge and the system and culture he represents...

This is why threads like this are a fucking miserable disgusting shitfests. People get emotional at abuse and the little Stalinoids start dropping out of the most unexpected places, craving blood and guts and torture this and that. No amount of abuse at a perpetrator is going to make up for the horrors of the departed or those already abused, and no further will bring back the already gone. You cannot stop injustices merely by extending further injustices.

That the judges would rule so daftly is rule rather than exception in the capitalist justice system, and travesties and disgusting mishandling just further proof that warrants its destruction.

It said the judge "suspended" all but the 31 days. Why bother sentencing only to suspend? My primary knowledge on sentences deal with domestic violence & this seems to not have happen in a Michigan case which why I am confused over it. Nothing states appeal or another judge, so what prompts a suspension?

I'm not thinking anyone here is a judge, so I might not be able to be answered 100% but to grasp how that occurred would be nice to know for any future arrests.

I assume "suspension" it something like "voorwaardelijk" here, people without long criminal records often get part of their sentense in "probationary" form already from the judge, if you get arrested again for a similar offense you have to do that sentence on top of your new one.
In principe a very good idea, but 31 days/20 years is completely insane. Normally its 50/50.

(CNN) -- A 30-day rape sentence (http://www.cnn.com/2013/08/28/justice/montana-teacher-rape-sentence/index.html) given to a teacher who admitted to raping his 14-year-old student may be illegal, according to the Montana judge who imposed it.
The judge scheduled a new hearing for Friday.
"The Defendant shall be present at argument as the Court, if necessary and appropriate, will amend the mandatory minimum portion of the sentence," read a court order filed Tuesday.
It appears the mandatory minimum is two years, not 30 days, the order said.
"In this Court's opinion, imposing a sentence which suspends more than the mandatory minimum would be an illegal sentence," it continued.

Scott Twito, a prosecutor with the Yellowstone County attorney's office, did not immediately return a call for comment.
In a memo from his office to the Montana attorney general's office, attorneys had argued the relevant statute was "misapplied and the minimum sentence that could be imposed in Rambold's case was two years" -- anticipating the judge's Tuesday order.
Rambold admitted to raping the girl while he was her teacher at her high school.

Case details
The case began in 2008 when Cherice was a student at Billings Senior High School and Rambold, then 49, was a teacher.
School officials learned of the relationship, and Rambold resigned.
Authorities charged Rambold with three counts of sexual intercourse without consent.
As the case wound its way through the legal system, Cherice committed suicide. She was a few weeks shy of her 17th birthday.
With her death, prosecutors entered into what is known as a "deferred prosecution agreement" with Rambold.
This meant that all charges against Rambold would be dismissed if he completed a sex-offender treatment program and met other requirements. One of them was to have no contact with children.
Rambold admitted to one of the rape charges.
But the ex-teacher fell short of the agreement.
"He had some contacts with nieces and nephews in a family setting and other adults were present," Baugh said.
He also had relationships with women that he didn't tell his counselors about.
"That is a violation from his deferred prosecution so he was dropped from the plan," said the judge.

The hearing
At a hearing last month, Baugh ruled that Rambold's infractions weren't serious enough.
"He made some violations of his treatment program," he said. "They were more technical and not the kind you would send someone to prison for."
He sentenced Rambold to 15 years in prison. Then, he suspended all but 31 days of the sentence, according to the Yellowstone County District Court.
The judge gave Rambold credit for one day he spent in jail.
Incredulous at what had happened, the victim's mother, Auliea Hanlon, shouted at the court, "You people suck."
"She wasn't even old enough to get a driver's license," Hanlon said in a statement released by her attorney. "But Judge Baugh, who never met our daughter, justified the paltry sentence saying she was older than her chronological age. I guess somehow it makes a rape more acceptable if you blame the victim, even if she was only 14."
