Dear Friend,

Please join the Free Marissa Now Campaign. The terrible injustice of the not-guilty verdict for Trayvon Martin's killer has brought Marissa Alexander's racist and sexist treatment by Florida courts to center-stage of U.S. and world attention. It is infuriating to think how Stand Your Ground was used to avoid any penalties for killing a Black teenager, while a Black woman is serving a 20-year sentence for firing a warning shot that injured no one to stop an attack by her abusive husband.

As the national Free Marissa Now campaign has stated: "The dramatically different outcomes of these cases is a lesson in how the criminal justice system routinely fails to support black people who defend themselves from violence on the streets, in their homes, and from institutions."

Over the last year Radical Women has collaborated with other organizations to build a massive outcry to win justice in this case. Statement from Free Marissa Now Campaign

Free Marissa Now Statement:

The political climate created by the George Zimmerman trial has shed light on the opaque imaginations of what some think is a post-racial nation. We are heartbroken for Trayvon Martin's family, who have demonstrated brave resolve throughout this ordeal and we hold them in our thoughts as we move forward. We send strength to the family of Jordan Davis, another unarmed Black male Florida teen murdered by a white male who claimed Stand Your Ground, and many others who are gearing up for their journey through these same halls of due process. As long as the Florida justice system has a double standard for identifying criminal behavior, it breaches our core right to safety. The Zimmerman case is about the freedom to safely walk the streets without being profiled and pursued as a criminal based on reemerging Jim Crow codes, especially in the south. Paradoxically, this trial has been juxtaposed to the Marissa Alexander case; a black woman who stood her ground in her home to defend herself from domestic violence and was consequently sentenced to twenty years in prison when no one was physically injured by her actions. The dramatically different outcomes of these cases is a lesson in how the criminal justice system routinely fails to support black people who defend themselves from violence on the streets, in their homes, and from institutions.

The Free Marissa Now Campaign is organizing to win freedom for Marissa Alexander, a proud African American mother of three with an MBA and a survivor of domestic violence. In August 2010, Marissa fired a single warning shot in the ceiling to halt her abusive partner during a life-threatening beating in her home. Marissa's husband, who has previously landed Marissa in the hospital after beating her, admitted in a sworn statement that he was the aggressor, threatened her life and was so enraged that he did not know what he would do. Despite the fact that Marissa caused no injuries and has no previous criminal record, and despite the fact that Florida's self-defense law includes the right to Stand Your Ground, she was arrested by Jacksonville police, charged with aggravated assault, and sentenced to twenty years in the Florida criminal correctional system.

We must take a stand against the criminalization of all survivors of domestic and sexual violence. Marissa's case is one of many that shows us how Black women and other marginalized people are especially likely to be criminalized, prosecuted, and incarcerated while trying to navigate and survive the conditions of violence in their lives. Freeing Marissa is a social justice action against intimate partner and systemic violence against all women, and an urgent call for the end of mass incarceration and support for truly transformative solutions to violence.

The Free Marissa Now Campaign is calling for the grassroots community to stand your ground about your right to give voice to this situation and not be complacent. Our hope was to see justice done for the death of young Brother Trayvon Martin, who couldn't tell his side of the story, and for his family. We grieve deeply with them and for others whose lives have been impacted by violence with no opportunity for redress. We will continue to support survivors of domestic violence and sexual assault to defend themselves without fear of criminalization and to tell their stories. We see this as another defining moment for racial and gender justice that comes on the heels of the rollback in voting rights.

There is justifiable cause for rage and protest of the violence of racism embedded in the Florida criminal justice system. This is not the time to shut down but show up and turn rage into resistance through organized and peaceful protests. We need to build a movement to stop racist murder and race and sex bias in the courts. We encourage people to use their resources to organize and voices to speak truth to power to create change.

We are standing our ground for peace and justice. We encourage organizers and survivors to share in our collective power and take action to Free Marissa Alexander!

Marissa Alexander and Cece McDonald are two other names that should not go without mention or juxtaposition when talking about Trayvon Martin and the issue of the courts in Florida and the US in general. In fact, I believe they are very much important and potentially integral to the movement.

Have you heard the great news? Last week a Florida Appeals Court overturned the guilty verdict against Marissa Alexander! The appeals court found extreme errors — the instructions to the jury said Marissa had to prove beyond a reasonable doubt that she acted in self-defense. This is the exact opposite of the legal principle that defendants are presumed innocent until proven guilty by the prosecution.

Free Marissa Now (http://radicalwomen.us6.list-manage2.com/track/click?u=2917cfc9b3941a9932e363014&id=3dc9038da6&e=7dc657b6d3) has launched a national campaign to get Florida to drop the case, dismiss all charges and release Marissa now. Radical Women is an active part of this campaign.

What happens next: From now until October 11, Florida Attorney General Pam Bondi could ask the Appeals Court to change its decision. This is called a rehearing. If Bondi doesn't request a rehearing, the case will be returned to Jacksonville.

Beginning on October 11, the ball is in State Prosecutor Angela Corey's court to move forward on the case or to drop it. This is the crucial period to get the case dismissed and flood Florida with messages to drop the case.

Please call, write, fax or email State Prosecutor Angela Corey, State Attorney General Pam Bondi, and Florida Governor Rick Scott to demand that they drop the case. Angela Corey is the person who will make the decision - but Bondi and Scott should demand that she not pursue the case.

It's time to stop this cruel and unforgivable vendetta against a mother of three who did no wrong, but defended her life by taking the only action she felt possible. Tell the state to stop using taxpayer money to hound and harass a domestic violence survivor. This innocent woman has already served several years.

Please take action and start spreading the word!

Marissa Alexander to receive new trial, protesters demand 'Free Marissa now'

Jacksonville, FL - On Sept. 26, a Florida appeals court ordered a new trial for Marissa Alexander, the African American mother given a 20-year prison sentence for firing a warning shot to fend off her abusive husband. The announcement comes after more than a year of protests across the country that raised the demand, “Free Marissa now!”

Speaking about the movement to get justice for Alexander, Octavia Littlejohn, an organizer with the New Jim Crow Movement and the Southern Movement Assembly in Jacksonville, stated, “I truly believe it helped Marissa's case...I pray she gets her freedom soon and very soon.”

Alexander, 32, discharged her licensed firearm when her husband attacked her at home just a week after giving birth to her daughter. The jury ignored her claim to self-defense against domestic abuse and found her guilty after deliberating for only 12 minutes. Under Florida's racist mandatory minimum laws, Alexander was sentenced to 20 years in prison.

Alexander's case drew national attention in the wake of the not guilty verdict in the trial of George Zimmerman, the white vigilante who murdered Trayvon Martin, a 17-year-old African American. After shooting Martin, Zimmerman was not arrested by police and a nearly all white jury found him not guilty of second-degree murder, sparking nationwide protests. Many protesters contrasted Alexander and Zimmerman's treatment by the legal system to highlight the racist nature of the criminal injustice system.

State Attorney Angela Corey, who was widely criticized for her lackluster prosecution of Zimmerman, prosecuted Alexander and sought the maximum 20-year sentence for her conviction. Several progressive and civil rights groups in Jacksonville have demanded that she resign for targeting Alexander and disproportionately prosecuting African American youth.

Protests in Jacksonville by the Southern Movement Assembly, the New Jim Crow Movement, Florida New Majority and others helped bring attention to Alexander's case. Shortly after the Zimmerman verdict, more than 500 people in Jacksonville marched to the Duval County jail, where Alexander was held, and demanded her release.

In late July, protesters with the Southern Movement Assembly walked 126 miles from Jacksonville to Sanford to demand the release of Alexander and the resignation of Angela Corey.

Littlejohn, one of those who participated in the 'Walk for Dignity' to Sanford, states, "We stood for what we believe in, and we didn't let anybody or anyone - not even Angela Corey - defeat us or scare us away. I feel we got what we wanted and justice will be served for her."

Groups in Jacksonville and across the country plan to ramp up the pressure to free Alexander as she faces her new trial.

Reflecting on this people's victory, Littlejohn added, "Marissa will be very pleased in our hard work and dedication. Our voices were heard. We overcame all obstacles, even if it meant for me being in the media and speaking on the truth, not giving a damn what the jurisdiction said about her. We fought for her freedom and her rights."

Jacksonville protesters rally at courthouse for Marissa Alexander re-trial hearing

Jacksonville, FL - Protesters from across Florida gathered in front of the Duval County Courthouse on October 31 for the first status hearing in the retrial of Marissa Alexander, the 33 year old African American mother who fired a warning shot to fend off her abusive husband.

The status hearing lasted just a few minutes as Judge James Daniel set November 8 as the date of Alexander's bail hearing.

Although protesters tried to enter the courtroom to show support for Alexander, Jacksonville police locked them out. The group of protesters regrouped outside for a press conference, where they discussed future plans to win freedom for Alexander.

Alexander's case drew national attention after the murder of Trayvon Martin and the not-guilty verdict in the trial of racist vigilante George Zimmerman, Martin's killer. Prosecuted under Florida's mandatory minimum sentencing laws, Alexander received a 20-year prison sentence for aggravated assault in 2012 despite only firing a shot in the air to defend herself from a domestic abuser. Zimmerman, on the other hand, received a not guilty verdict after murdering Martin, an African American youth. Protesters contrasted the cases to show the racist and sexist nature of the criminal injustice system.

The Zimmerman verdict brought new attention to Alexander's case, launching nationwide protests demanding her release. The Southern Movement Assembly led a 126-mile walk from Jacksonville to Sanford in August demanding Alexander's freedom and the resignation of State Attorney Angela Corey, who prosecuted her case. On September 26, 2013, a Florida appeals court ordered a new trial for Alexander.

Over 30 people attended the press conference afterwards, bringing together members of the Southern Movement Assembly, the New Jim Crow Movement, Sisterhood of Survivors from the Miami Workers Center, the Southern Christian Leadership Conference, the Freedom Road Socialist Organization, Dream Defenders, the Jacksonville Progressive Coalition, the New Black Panther Party, and Florida New Majority.

Speakers focused on domestic violence, the racist criminal justice system, the school-to-prison pipeline, and Florida's mandatory minimum sentencing laws, which disproportionately affect African Americans and other oppressed nationalities.

Shay Brown talked about domestic violence and pointed out that the state of Florida does not take the safety of women seriously. As a domestic violence survivor and victims' advocate, she pointed out that women and abuse survivors everywhere have an interest in seeing Alexander freed. Other speakers denounced the racist criminal injustice system for incarcerating Alexander in the first place.

"They had the white robes of the KKK in the 60s," said Minister Richard Burton of the Epiphany Baptist Church in Jacksonville. "And they have the black and blue robes inside the Duval County Courthouse today."

Florida State Senator Dwight Bullard sent a staff member to read a letter expressing his support for Alexander and demanding her freedom. "I urge you to drop the charges on Marissa Alexander," read Bullard's letter, "and I urge you to drop the new trial."

At the end of the press conference, chants broke out of "Free Marissa Now!" and "What do we want? Freedom for Marissa! When do we want it? Now!"

Protesters plan to rally at the courthouse for the November 8 bail hearing at 2:00pm and demand, "Free Marissa Now!"

The movement to free Marissa Alexander and demand that all charges against her be dropped is growing!

In honor of Domestic Violence Awareness Month, the UC Santa Cruz Women’s Center hosted the first event on campus about Marissa's case. Those who attended pledged to join the struggle.

In anticipation of Marissa’s October 31 status hearing, WORD Santa Cruz gathered activists the Monday evening before the hearing at the main entrance of the University, a busy transportation hub, to pass out fact sheets and the number to call Prosecutor Angela Corey to demand the case against Marissa be dropped.

WORD signs reading “Free Marissa Alexander Now” in English and Spanish and “Say No to Racism and Sexism,” with photos of Marissa, helped raise awareness about the movement to free her. Cars honked in support and many people took flyers and said that they would make a call to support Marissa Alexander.

On the morning of Marissa's status hearing, WORD activists in Washington, D.C., did outreach during the busy downtown rush hour to spread the word about the case. Earlier in the week, activists in San Francisco and other cities did the same.

Now is the time to intensify our efforts spreading the word about Marissa's case and demanding her freedom.

Despite the fact that the original guilty verdict was overturned, Florida State Attorney Angela Corey is moving ahead with the unjust prosecution of Marissa Alexander. At the status hearing on October 31, a bond hearing was scheduled for November 8th and a new trial was set to begin March 31, 2014. Marissa's new trial is taking place in the same venue where she was originally convicted of aggravated assault. She was sentenced, under mandatory minimum sentencing laws, to 20 years in prison in the same state that let George Zimmerman walk free.

There is no crime in defending yourself from abuse. Marissa Alexander acted in self-defense and injured no one. She is a survivor of domestic abuse, and is only imprisoned because of this racist and unjust legal system. Marissa Alexander should not be subjected to a second trial. All charges against her should be dropped immediately.

The fight to free Marissa Alexander continues. Alexander is an African American mother who was sentenced to 20 years for firing a warning shot to stop an attack by her abusive husband. In September, a Florida Appeals court overturned her guilty verdict and she secured the right to a new trial. The new trial is scheduled to begin March 31, 2014.

On Nov. 13, Judge Daniels failed to grant Marissa Alexander's request to be released on bond. He heard arguments, but said he will decide later, perhaps before the end of the year. Meanwhile, Marissa is still in jail. The national Free Marissa Now campaign statement on the hearing is below.

Not guilty but still in prison: Justice denied to Marissa Alexander

An appalling injustice took place today in Jacksonville, Florida when Judge James Daniel failed to grant Marissa Alexander's request to be released on bond until a verdict is reached in her new trial that begins March 31, 2014. At the end of September, a Florida Appeals Court threw out the guilty verdict against Ms. Alexander and ordered a new trial due to severe problems in the instructions to the jury. With the overturn of the original verdict, Marissa Alexander is no longer guilty in the eyes of the law, but she is still in prison.

Marissa Alexander, an African American mother and daughter, was sentenced to 20 years for firing a warning shot to stop an attack by her abusive ex-husband -- an act of self-defense that injured no one. She was denied a Stand Your Ground defense. She has already been separated from her young children and family for nearly three years. The youngest was only 9 days old when the domestic violence incident occurred.

Release on personal recognizance or bond is supposed to be allowed to defendants who present no risk of flight or danger to the community. This mother of three is firmly rooted in the Jacksonville community by her connections to family, children and friends. She poses no danger to the public. Or has the state of Florida decided that she is a danger for the sole reason that she is a black woman?

It is well documented that black women and other marginalized people are likely to be criminalized, prosecuted, and incarcerated while trying to navigate and survive the conditions of violence in their lives. This is especially true for black women who are subjected to racist stereotypes that paint them as overly aggressive and unworthy.

The Free Marissa Now Mobilization Campaign is undaunted in our passion to win Marissa Alexander's release.
