*NOTE* This isn't really a question about revolutionary/radical/class politics, just about the functioning of the US government.

So Romney has said that he would repeal the Affordable Care Act if elected. Back in May the US Supreme Court ruled that the Act was constitutional. From my understanding ONLY the US Supreme Court can repeal a bill that has become law (judicial review). So why hasn't Obama called Romney out on lying? He was a constitutional lawyer. Maybe to keep people afraid of his opponent?

Congress can repeal a law that was previously passed, they do it all the time. Basically Romney is saying he would use the bully pulpit to pressure the Congress into getting rid of it, not that he personally (or a representative of the Executive branch) would get rid of it.

the bully pulpit to pressure the CongressHa, that thing that Obama only uses when the Banks need money - and then conviniently forgets about anytime people say racist shit or when he feigns trying to get legislation he promised voters through.

I always use Obama's excuses for things now: "Ugh, I reeeeally want to cat-sit for you for free for a month... but damn, there's just too much opposition from those obstructionist Republicans. So we worked-out a compromise: I still don't get paid, but I don't watch your cat either. What can I say we need to lead by example and be reasonable and bi-partisan!"

Moot point now, but, yes, Congress has the power to repeal its own acts.
