Massive effort across country to defend Carlos Montes

Los Angeles, CA - On April 26, Superior Court Judge George G. Lomeli ordered the trial of longtime Chicano and immigrant rights activist Carlos Montes. The trial will start on May 15. Shortly after this trial date was set, a massive campaign began around the country to demand L.A. District Attorney Steve Cooley to drop all charges against Carlos Montes.

“We have begun a massive effort to pack the courtroom in support of Carlos,” said LA Committee to Stop FBI Repression member Eric Gardner. Organizers called over 300 supporters in the Los Angeles area to get commitments to attend court dates. Carlos Montes has done four interviews on progressive radio station KPFK and there are more coming up. Jess Sundin, one of the activists whose home was raided in Minneapolis on Sept. 24, 2010, came to L.A. to help make sure that, for every day of the trial, the court is packed. “Carlos is an important leader of the Chicano struggle for self-determination and that will show at the Los Angeles Court house starting on May 15.”

Organizations from around Los Angeles, including SEIU 721, The Bus Riders’ Union, United Teachers L.A. and many area MEChA chapters are mobilizing to bring people out for Montes’ trial.

At May Day celebrations around the country, activists handed out leaflets to build support for the campaign and to urge people to call the Los Angeles D.A.’s office at 213-974-3512. Many who called on the May 3 call-in day had to call back because the lines were jammed for most of the day.

With help from the International Action Center, the Committee to Stop FBI Repression posted a new on-line petition that sends messages directly to the offices of Los Angeles District Attorney Steve Cooley, U.S. Attorney General Eric Holder and President Obama. Nearly 2000 signatures have been gathered since May 5. The petition is at Defend Carlos Montes.

Montes was arrested May 17, 2011, in a raid by the FBI and the L.A. Sheriffs as part of an investigation of “material support of terrorism” which has targeted 23 other anti-war and solidarity activists. Montes now faces 4 felony charges.

The outpouring of support has been overwhelming. The Committee to Stop FBI Repression asks that groups and individuals from the Los Angeles area join us at court May 15 through May 23, at 210 Temple Avenue in downtown Los Angeles. They also ask that people around the country keep calling Los Angeles District Attorney Steve Cooley at 213-974-3512 to demand, “Stop the frame-up of Carlos Montes. Drop the charges now!”

Fellow activists, organizers and friends,

So, after some discussion with a few activists, we decided we are going to have a protest for Carlos Montes on Wednesday, May 16th at 4:30 pm at the corner of Adams and Dearborn. Join us, raise your voice to demand the charges against Carlos Montes be dropped today. We will have signs, but bring your own if you can. Wednesday will be day two of the trial out in L.A.

Statement from the LA Committee to Stop FBI Repression

Los Angeles, CA – Over 100 supporters rallied in front of the Los Angeles Superior Court today, May 15, to demand, “Drop the charges against Carlos Montes.” The supporters included MECHA students, union members, teachers, vendors and community members as well as activists from the anti-war movement.

“With your help we will win this case,” Montes told the crowd. “The repression against me is an attack on all of our movements. Thank you all for your solidarity! Together we will win!”

Following this strong showing of solidarity, supporters then moved in to the packed courtroom. Montes was set for trial. Due to a new development in the case, the trial was moved to Wednesday, June 20, 2012. The new development deals with obtaining information needed to clarify the legal record. The defense lawyer, Montes, and the district attorney agreed to the June 20 date, to give enough time to investigate this information that would help defeat this attack against Montes and our movement.

The struggle continues, we will continue to demand “drop the charges” and await the new findings that will clear the charges, if not we go to trial on June 20.

Carlos Montes is facing multiple felony charges because the FBI claims he is a felon in violation of firearm codes. The FBI claim stems from a 1969 student strike for Black, Chicano and Women’s studies at East L.A. College, where police beat and arrested demonstrators. Montes was arrested on his way home from the protest, accused of assaulting a sheriff’s deputy (with an empty soda can). This charge was sentenced as a misdemeanor according to a recently uncovered court document. District Attorney Steve Cooley, under the guidance of the FBI, is basing his case on this 42-year-old misdemeanor, disguising it as a bogus felony. Without a past felony, all of the charges Montes is facing, relating to his legally purchased firearms, would be dismissed. Both sides agree that no prison time whatsoever was served in the 1969 incident. The legal process is being driven by something other than the facts of the case. It is political repression.

“In the weeks ahead we need to keep putting pressure on the District Attorney to drop the charges,” states Mick Kelly of the Committee to Stop FBI Repression. “The prosecution of Carlos Montes is part of a broader attack by the FBI and local police on anti-war and international solidarity activists. We need to do everything in our power to push back.”
