Update on Jalil Muntaqim
via Brooke Reynolds
January 29, 2012

Hello Everyone,

I am writing you urgently after a visit to Jalil Muntaqim yesterday (Saturday). He is currently in SHU at Attica, having been hit with 6 months after his trial on Monday. He put a full report about what happened in the mail, which I will type up and send out as soon as I receive it, but here is the basic jist of what happened:

On Monday, he was taken down to trial regarding the photograph that was “recovered” in his cell (the photo was from Cetewayo's memorial held at Hunter College this past March, in which a Black Panther Party banner was hanging in the background. Guards confiscated the photo on grounds that it demonstrated “unlawful organization.”) This photograph had been sent in through the mail, and therefore presumably been processed through Attica's correspondence department. Jalil had lined up 3 witnesses for this bogus trial:

The head of Attica's correspondence dept., to argue that mail sent in through correspondence could not be considered contraband after the fact;

The head of Attica's gangs unit to show that the Black Panther Party is not a designated gang (originally, the charges included gang affiliation as well);

Jalil's counselor, to demonstrate good behavior and non-involvement in unlawful organizations.

When he arrived to the trial, he was told all 3 of these witnesses were denied on the basis of “irrelevancy.” He was therefore unrepresented and with no witnesses. A lieutenant was then brought in, confirmed that the photo was of unlawful organization, and Jalil was hit with 6 months SHU right then and there.

He has been in SHU since Monday, with only the clothes on his back. He has not been given any personal property, and was told he probably won't receive any of it for weeks. He has no phone privileges, no commissary, no packages, and will eventually be allowed 5 books and limited legal materials. He will have only one visit weekly for the duration, and these are no-contact visits which take place in Attica's SHU.

He is asking that people contact NYS Attorney General Eric Schneiderman, as well as Commissioner Brian Fischer, to demand that the charges be dropped, Jalil be released from SHU immediately, and that this campaign of harassment come to AN IMMEDIATE END! These charges are entirely fabricated and show premeditation on behalf of the prison administration to lock Jalil away until his next parole hearing in June.

[icffmaj] BROTHER JALIL NEEDS OUR IMMEDIATE HELP! HE'S IN "THE HOLE" AT ATTICA!

We learned how effective the "power of the people" can be from our successful battle to get Mumia off Death Row and now our recent victory of getting him out of "the hole" in Mahanoy and into General Population. Still only a step toward his release from prison altogether.

Now another political prisoner, a very brave revolutionary, Jalil Muntaquim, needs our immediate help. He's been thrown into an SHU for six months (!!!) in an outrageous kangaroo court proceeding for having a Black Panther Party emblem on a memorial program, cleared through the prison mail, in his cell! He was denied the opportunity to have three knowledgeable and completely relevant prison officials testify for him in this hearing. WE MUST HELP JALIL IMMEDIATELY! CALL, WRITE, AND SPREAD THE WORD. DO FOR JALIL WHAT WE ALL DID FOR MUMIA! CALL AND WRITE ATTORNEY GENERAL ERIC SCHNEIDERMAN AND NY STATE DOC COMMISSIONER BRIAN FISCHER. BE SURE TO IDENTIFY JALIL AS ANTHONY "JALIL" BOTTOM, DIN#77A4283. DEMAND THAT HE BE REMOVED FROM SHU AND PLACED IN GENERAL POPULATION AND THAT HE BE TRANSFERRED OUT OF ATTICA!. Note: see letter below issued by Soffiyah Elijah, Executive Director of the Correctional Association of NY State calling for the closing of Attica.

Letter from the Executive Director

Beyond Repair

By Soffiyah Elijah, Executive Director

After forty years, Attica Correctional Facility has failed to evolve into a safe place for prisoners. Improvements found by our Prison Visiting Project on their April visit to the facility, while encouraging, were grossly overshadowed by serious concerns for the safety and well-being of the people imprisoned there.

Four decades since the Attica uprising, the fundamental flaw at the facility continues to be poor prisoner-staff relations. Attica today has alarmingly high levels of violence and abuse. Force and threats are still very much the norm. The environment of fear and intimidation inside the prison can be seen in the prisoners' downward-cast eyes and tense body language, consistent with a person suffering from abuse. Widespread racism, one of the principal complaints of Attica prisoners in 1971, remains among the most serious concerns of Attica prisoners in 2011. From prisoner-staff relations to housing assignments, facility movement and even program times, the atmosphere that existed prior to the rebellion lingers, pervading nearly every aspect of the facility.

Unable to cast off its violent past, Attica Correctional Facility stands as a bold testament to inhumanity.

The events at Attica in September of 1971 left irreparable wounds and inflicted lasting harm upon survivors. Many continue to suffer from symptoms of depression, anxiety, and post-traumatic stress. The State of New York is long overdue in issuing an apology to the survivors of the massacre. For the incarcerated men who were brutalized and tortured in the days that followed the assault, the families of the 39 people killed by the troopers, and the prison workers taken as hostages in the uprising—an apology could represent one small but vital step towards healing these injuries.

Unable to cast off its violent past, Attica Correctional Facility stands as a bold testament to inhumanity. It is broken beyond repair, and Governor Cuomo should shutter its doors forever. Symbolically, the closure of the facility would serve as an acknowledgment of the violence and brutality inflicted upon the prisoners of Attica at the hands of the state. Fiscally, prison closures continue to make sense for our cash-strapped state. Recognizing the inefficiency of New York's over-reliance on incarceration, Governor Cuomo has already designated several facilities for closure.

These downsizing efforts should continue, and Attica should be next on the Governor's list.
