URGENT ACTION: Daily News launches Political Attack On Oscar Lopez Rivera!

On Saturday January 21st, the Daily News published an article by Mara Bovsun titled, "Justice Story: FALN bomb kills 4 at Fraunces Tavern, where George Washington said farewell to troops"[1] in which she details the history of the armed action organized by the FALN at Fraunces Tavern on January 24th, 1975.

At the end of the article, she mentions that Puerto Rican Political Prisoner Oscar Lopez Rivera, who was a member of the FALN, was denied parole last year and quoted John Connor, the son of one of the Fraunces Tavern victims, `Finally…some justice forour father, Frank Connor, and other victims of the FALN."'

This article is a one-sided hit piece that attempts to portray Oscar as a terrorist who is getting his "just deserts." The Daily News must be held accountable for reporting the facts of Oscar's case.

For example: In a highly unorthodox and controversial move, John Connor and other family members of the Fraunces Tavern bombing were allowed to give testimony at Oscar's parole hearing to prejudice the parole board. Oscar's defense team protested their attendance and asked for them to leave; there request was denied.

Oscar was never charged with or convicted of the Fraunces Tavern action, therefore can't be held responsible for it; their testimonials against him should not have had any bearing on his parole hearing and should not have been allowed.

While incarcerated, Oscar's behavior has been exemplary and support for his parole has come from religious leaders, academics, union leaders and elected officials throughout Puerto Rico and the United States. In fact, thousands of letters, telephone calls and emails have been made and continue today calling for Oscar's release.

The ProLibertad Freedom Campaign is asking our supporters to call the Daily News' News Department and demand that an article be published on the international movement for Oscar Lopez Rivera's parole! Demand that the News Department speak with Oscar Lopez Rivera's legal representatives, his supporters and family members! Demand a stop to this yellow journalism and fairness in the news reporting!

The U.S. government announced today that Oscar López Rivera, who has been imprisoned in the U.S. for 36 years for his struggle to free Puerto Rico from U.S. colonial rule, will be released from prison on May 17. Courageous whistleblower Chelsea Manning, whose leaks of videos and government documents revealed U.S. war crimes, will also be freed at the same time, with her 35-year sentence reduced to 7 years.

Upon returning to Chicago after serving in the Vietnam War, he joined the struggle for the rights of the Puerto Rican people and participated in acts of civil disobedience and other actions.

"In 1976, he joined the clandestine fight for the independence of Puerto Rico as a member of the Armed Forces of National Liberation. In 1981, he was captured by the FBI accused of "conspiracy" and for his militancy in the FALN.

"At the time of his capture, he proclaimed himself a prisoner of war, protected in the first protocol of the Geneva Convention of 1949. The protocol protects López for being a person arrested in conflict against colonial occupation. The U.S. did not recognize the demand of López and sentenced him to 55 years in prison, after an alleged attempt to escape, the sentence increased to 70 years in prison, 12 of which have been spent in isolated confinement."

The Cuban Five were among the many people around the world active in the struggle to free Oscar. Just as with Obama's decision to improve relations with Cuba, pressure from around the world and particularly from Latin America was essential in winning this victory.

Gerardo Hernández said today: "Hoy podemos celebrar. El ejemplo de ese patriota puertorriqueño nos sirvió de inspiración a los Cinco. Sabíamos que su pena era larga y que había estado preso mucho más tiempo que nosotros. Si Oscar no flaqueó, nosotros tampoco podíamos hacerlo. Nos alegramos por él y sus familiares". ["Today we can celebrate. The example of this Puerto Rican patriot was an inspiration to the Five. We knew that his grief was long, and that he had been imprisoned much longer than us. If Oscar did not falter, we could not do so either. We rejoice for him and his family."]

The struggle continues for other political prisoners, including Ana Belén Montes, Leonard Peltier, Mumia Abu Jamal, and so many more. Others, like Assata Shakur and Edward Snowden, would undoubtedly become political prisoners if the U.S. were to get its hands on them. Yesterday something truly historic happened. After -----years of activists and organizers fighting for the release of political prisoners President Obama commuted the sentences of whistleblower Chelsea Manning and Puerto Rican liberation leader Oscar Lopez Rivera. We call on President Obama in his last days in office to commute the sentences of political prisoners who have spent decades unjustly behind bars. These activists were targeted by programs like COINTELPRO for their political activity. Despite having inspired millions, these freedom fighters continue to face repression due to their unapologetic commitment to the fight for racial, economic and social justice. People like Leonard Peltier, Mumia Abu-Jamal, Veronza Bowers and Dr. Mutulu Shakur, should not be behind bars. Now is time they come home. This is why today we’re asking President Obama to #FreeEmAll. The urgency of this moment requires all of us to take action in the final days of the Obama Administration.

It is with great joy that we welcome yesterday’s news that longtime Puerto Rican freedom fighter and political prisoner Oscar Lopez Rivera, as well as imprisoned whistleblower Chelsea Manning, will soon be freed. President Obama’s announcement of the commutations of their sentences did not come spontaneously or out of his good will, but as a result of decades of organizing and struggle by people demanding and working for the freedom of political prisoners.

The majority of Obama's commutations have been for those imprisoned for non-violent drug offenses. And while we welcome all imprisoned people coming home, we remain steadfast in our work towards abolitionist reforms that shrink the prison industrial complex and touch the lives of all those imprisoned, regardless of level of charge or classification.

As we move into a political climate that appears bleak, these victories give us hope, and remind us of why we must double down on our struggles against imprisonment, policing, surveillance, and on movement building toward liberation in light of what is to come in the coming days and years. In the words of Rivera "It is much easier not to struggle, to give up and take the path of the living dead. But if we want to live, we must struggle."

President Obama recently commuted the sentences of 273 people. Dr. Mutulu Shakur needs to be person 274. The continued incarceration of Dr. Mutulu Shakur is representative of the failure of our criminal justice system in working towards the stated goal of rehabilitation. Dr. Mutulu Shakur is being held for punitive purposes because he broke the law in the service of a movement meant to break systemic racism. We demand that our criminal justice system works in the way that the system says it should.

Dr. Mutulu Shakur has been incarcerated for over thirty years where he's been denied parole eight times despite taking full responsibility for his actions and committing himself to community healing and alternative dispute resolution mechanisms while under state control. As President Obama has said about the recently commuted Chelsea Manning sentence, justice has been served. It is time for Dr. Mutulu Shakur to be released and allowed to rejoin his community as an elder and a resource to help others.
