A 12-year-old boy who raped his teacher and then stole her car was today detained for life.
The schoolboy attacked the woman as she sat next to him during a one-to-one teaching session. Afterwards, he took her car and drove it for 30 miles before dumping it in Gateshead on Tyneside.
The boy, who has severe learning difficulties, admitted at an earlier hearing that he had raped the teacher at a special needs centre in County Durham and then stolen her car in November 2004.
Today at Teesside Crown Court, Mr Justice Grigson ordered the boy, who cannot be named for legal reasons, to be detained for life. The child is one of Britain's youngest convicted rapists.
Personally, I think that a culture where a child can be abused physically, emotionally, even sexually and then press charges on them because he does a similar thing... well, something's wrong, we all know that.

On one hand, I doubt he will ever be able to be rehabilitated into society, but given his past experiences the idea that he deserves to sit in a jail cell for the rest of his life seems... cruel.

The article said he would be eligible for parole in 21 months. Since this article is 6 years old, he may have been released already.

This is a very difficult issue, a child committing a violent crime like rape. Clearly he's a danger to the community, but the bourgeois justice system is generally a poor way to deal with crime of any sort.

Detained where? In a medical institution I hope, seeing as though he is clearly ill. Prison is the last place a sick person should be sent, especially if the person in question is a child.
This vaguely reminds me of the 14-year-old boy facing the possibility 6 years in an Indonesian prison for marijuana possession right now.

Anyone have any updates on this case? I don't care what crime it is, sentencing a 12 year old to life is never the most sensible or "just" solution.

And it's not "PC", it's a matter of discouraging comments like those that serve to perpetuate a society where rape is a daily occurrence and the victims are frequently blamed more than the perpetrators, if anyone is even blamed at all. A lot of posters here are rape victims themselves, so you could at the very least have some respect for the trauma and horrific pain they've gone and continue to go through even if you're unwilling to recognize the role that comments like those play in perpetuating a culture of rape and violence.

As for this case - while the article is six years old, it does raise a worthwhile discussion. I don't think there's any discussion (apart maybe from a few of our resident dinosaurs) that this boy should be rehabilitated, but at what point can we definitively say that that's been done? Is the boy a psychopath (in which case there's really no guarantee he won't do it again) or does the problem lie elsewhere? If so, at what point should we feel safe letting him out again?

You make sound points Obs about the case. Rehabilitation or in the case of mental illness, treatment is paramount. If the child exhibits psychopathic, then medical treatment is of no use. My brother deals on a daily basis with psychopaths, in a residential setting, in the community..under home office license. Put crudely, there is a carrot and stick approach. Behave or go back inside. All have still the capacity to harm themselves and others. He is very dedicated to this work as are the staff. As for the young fellow if you followed the link I provided you will see there was a miscarriage of justice. I don't know all the facts SO I am loathe to engage. All in all it's a powder keg....declining social services...medical facilities..a public that rightly wishes to be protected.....a media that seems hell bent on getting mileage out of human tragedy. All in all I am not expecting good outcomes.

The kids who killed Jamie Bulgar were tried in an adult court and also recieved life sentences. The age of criminal responsability in England is I believe 10. That means you pull any naughty after hitting that age you can be tried in an adult court & recieve adult sentences, but rarely happens.

The Guardian isn't known for bullshit stories, it tends to follow a left/libertarian editorial line unlike most of the rest of the British press. Not saying this isn't some sorta elaborate hoax but it's highly unlikely given the scource and it's political leanings, if it came from the Daily Mail I'd be more inclined to entertain the idea it was a hoax.

No, you can apply for parole after the tariff is up and full life tariffs are normally only given to serial killers. The boy was given a period of twenty one months before parole, though the judge warned him he probably wouldn't be released then so I would guess he did four or five years. He will almost certainly be out by now.
The law works differently in England than it does here in Scotland which I am more familiar with, but the basics are the same so I can give a rough overview. When someone is released from a life sentence they are on what is known as a "license" which means they are released under conditions set by the parole board, usually of the "don't commit any more crimes" variety but may also include requirements to stay away from certain areas, not to associate with certain people and so on. Keeping in contact with a probation officer is also a normal requirement. If you violate the terms you can be recalled to prison and your sentence is reactivated meaning you need paroled for the original life sentence again before you can get out.
For instance the Jamie Bulger case was brought up by another poster and it provides a good example because yesterday it was reported in the news that one of the killers has completed a short sentence for child pornography but will remain in prison because he is not receiving new parole for the original life sentence.
The area I am not sure about with regards to England is how exactly it works with under 18s. In Scotland if you are under 18 you get sentenced to "detention without limit of time", the parole requirements in such a case are typically more relaxed, but I am not sure if an equivalent exists in England.
Also as a final note, in both countries you can't go to Young Offenders Institution (prison for under 21s) until you are 16, so the boy will have been put in a detention centre and they are considerably more humane.

Life under the UK penal system does not actually mean life. The kid was eligable for parole after 21 months.
