On March 28, 2011, the US Supreme Court failed to take up the appeal of Troy Anthony Davis, the Savannah, Ga. man whose scheduled execution has been halted three times in the past because of the growing evidence and public belief in his innocence. AND NOW HIS EXECUTION HAS BEEN SET FOR WEDNESDAY, SEPTEMBER 21.

Troy Davis is an African American on death row in Georgia. Davis was convicted in the 1989 killing of a police officer despite what Amnesty International calls "overwhelming doubts about his guilt." No physical forensic evidence was presented at Davis' trial, and 7 of the 9 non-police witnesses have recanted their testimony, with at least two saying they were pressured by police to finger Davis as the killer.

Chicago protest demands: “Stop the Execution of Troy Davis”

Chicago, IL - Death row prisoner Troy Davis was denied clemency today, Sept. 20, by the Georgia Board of Pardons and Paroles. He is scheduled to be executed tomorrow night.

Emergency protests are being held around the country. In Chicago, Amnesty International, Students for a Democratic Society and other groups gathered in front of the national headquarters of President Obama’s re-election campaign.

Mark Clements of the Campaign to End the Death Penalty had just returned from Atlanta where he had been with supporters of Davis outside the Georgia State Capitol. He told Fight Back!, “Seven out of nine witnesses have recanted their testimonies. The parole board says that these witnesses are less than credible now, but they were credible enough to convict him. How could that be?”

Clements has first-hand knowledge of the racist justice system in the US. He served 28 years in prison after being tortured into making a false confession by Chicago police.

Last minute appeals are being directed to Chatham County District Attorney, Larry Chisolm. He has the power to withdraw the death warrant. Clements said that the struggle for Davis’s life will continue until the last minute.

The Obama/Holder Justice Department should launch a federal civil rights investigation right now into the case of Troy Davis and seek a stay of his execution that is scheduled for tonight at 7pm.

President Obama, who routinely lectures sovereign governments abroad about civil rights and human rights issues within their countries, has until now said nothing to the state government of Georgia that allowed racist police forces to intimidate and coerce witnesses in the effort to execute an innocent Black man.

It’s not too late to act. The clock is ticking before an innocent man is put to death.

Background to the case of Troy Davis

More than 1 million people have signed a petition in support of Troy Davis. Demonstrations have taken place around the country and the world. Even the former director of the FBI has said that this execution is an injustice and should not go forward.

Of the nine witnesses, seven have recanted or altered their version of events. Five have signed statements saying they were coerced by police to testify against Davis, a common element of many racist “legal lynchings” targeting Black people. Three witnesses said that another man confessed to them that he killed the police officer.

The execution of Troy Davis shows with full clarity the true character of the racist legal system in the United States—its complete failing as any arbiter of justice. Davis has accessed all allowed avenues of appeal in the U.S. justice system in his quest not be put to death, an innocent man.

The members of the politically appointed Georgia Board of Pardons and Paroles, impervious to any accountability to the people, have decided that they wish for Troy Davis to die. With their announcement today that they have denied clemency to Troy Davis, he is on course to be executed this Wednesday, Sept. 21 at 7pm Eastern, in the state of Georgia.

Absolutely no physical evidence has been found that implicates Davis in the killing. No murder weapon has ever been found, exposing yet another major gap in the prosecution’s case. This is the fourth time the state of Georgia has set an execution date for Davis, who was wrongly convicted of killing a police officer in 1989.

The ANSWER Coalition has been joining with hundreds of other organizations in demonstrations throughout the country in recent days and weeks.

There is worldwide opposition to Troy Davis's execution. On Sept. 16, coordinated protests took place in cities all over the United States and the world.

Over 650,000 signatures in support of Troy Davis were delivered to the parole board. Now, over 1 million people have signed petitions in his support. JACKSON, Ga. - Troy Davis, the condemned inmate who convinced hundreds of thousands of people but not the justice system of his innocence, filed an eleventh-hour plea Wednesday asking the U.S. Supreme Court to stop Georgia authorities from executing him for the murder of an off-duty police officer.

His execution had been set to begin at 7 p.m., but as the hour arrived, Georgia prison officials were still waiting for the high court's decision.

Though Davis' attorneys say seven of nine key witnesses against him have disputed all or parts of their testimony, state and federal judges have repeatedly ruled against granting him a new trial.

As the court losses piled up Wednesday, his offer to take a polygraph test was rejected and the pardons board refused to give him one more hearing.

I'd just like to clarify something about one of these petitions. I don't think Obama can do anything in this case. Davis was tried in a state court, and convicted of a state crime. The president can only pardon "offenses against the United States", he has no power to pardon state crimes. I could be wrong, about where Davis was tried though.

Execution of inmate delayed by top court appeal

(Reuters) - Georgia was set to execute on Wednesday a man convicted of murdering a police officer in one of the highest-profile U.S. capital punishment cases in years.

Troy Davis was set to be executed by lethal injection at 7 p.m. local time (2300 GMT) but the execution was delayed for more than two hours while the U.S. Supreme Court considered whether to hear a last-minute appeal by his lawyers.

The case has attracted international attention and an online protest that has accumulated nearly a million signatures because of doubts expressed in some quarters over whether he killed police officer Mark MacPhail in 1989.

MacPhail was shot and killed outside a Burger King restaurant in Savannah, Georgia, as he went to the aide of a homeless man who was being beaten. MacPhail's family say Davis is guilty and should be executed.

Outside Georgia Diagnostic and Classification prison, hundreds of protesters chanted "Please don't let Troy Davis die" and "I am Troy Davis" and other slogans and a cheer briefly went up when it was reported that the execution had been delayed.

The demonstrations, which began in the early afternoon, took place amid a heavy police presence and at least two people were arrested.

"Our hearts go out to them (MacPhail's family). We have nothing but sympathy and prayers for them but they are not getting justice if the wrong person is paying for what happened to their son, their brother," civil rights leader Al Sharpton told reporters at the prison.

Since Davis's conviction, seven of nine witnesses have changed or recanted their testimony, some have said they were coerced by police to testify against him and some say another man committed the crime.

No physical evidence linked Davis to the killing.

APPEALS PROCESS

Once a death warrant was signed, Davis's best hope of avoiding execution had rested with the Georgia Board of Pardons and Paroles but on Tuesday it denied him clemency following a one-day hearing.

On Wednesday, his lawyers requested a polygraph in a bid to halt the execution and show his innocence, but prison officials rejected the entreaty.

The lawyers also filed a motion to stay in the county where the execution is set to take place. That was denied and Georgia's Supreme Court later turned down an appeal, according to media reports.

Defense lawyers appealed that ruling to the U.S. Supreme Court, said Sara Totonchi, executive director of the Southern Center for Human Rights.

Defendants in capital cases in Georgia are much less likely to face the death penalty if they can afford legal counsel and Davis was assigned a court-appointed lawyer who was overworked and underfunded, Totonchi said.

"Davis was poor, from a poor neighborhood and was given a court-appointed lawyer at a time when Georgia was providing next to no funding (for the defense in capital cases) ... He slipped through the cracks," she said.

A handful of supporters of capital punishment in the case also protested separately from Davis' supporters.

"I came here today because I want to see justice done. I am very sensitive to law officers getting hurt and injured in the line of duty," said Janet Reisenwitz, who said her daughter is a police officer in Georgia's DeKalb County.
