A federal appeals court on Tuesday ordered a new sentencing hearing for convicted police killer and death-row activist Mumia Abu-Jamal, finding for a second time that the death-penalty instructions given to the jury at his 1982 trial were potentially misleading.


The 3rd U.S. Circuit Court of Appeals ordered prosecutors to conduct the new sentencing hearing within six months or agree to a life sentence. Abu-Jamal's first-degree murder conviction nonetheless stands in the fatal shooting of Officer Daniel Faulkner.

This is pretty significant for the case, though the fact that there hasn't been a reopening of the case in trial considering the evidence of the original case is incredible.


Anyone ever read the book "murdered by Mumia" written by the policeman's wife? Looked like a piece of propaganda to me.

The recent book The Framing of Mumia Abu Jamal by J. Patrick O'Connor is an excellent look at the objective evidence and how it proves that Mumia was railroaded for purely political reasons. You couldn't pay me enough to read Maureen Faulkner's Murdered by Mumia.

It's good that the case is moving forward but it's got to be won in the streets. OnaMOVE! Free Mumia!

Mumia has been sitting on death row longer than "The Nightstalker" Richard Ramirez. I fear that his time may be running out. I hope not. :thumbdown:
