I think it was a Dutch council communist named Marinus van der Lubbe.

Actually, van der Lubbe was framed- something which was suspected since the time of the fire itself, and formally declared by the German government in 2008. It's now generally thought that the fire was started by a troop of SA men lead by Hans Gewehr, under orders from Goebbels. All participants were later murdered during the Night of Long Knives (regardless of their actual political alignment in that struggle), except for Gewher, who died during the war.

Marinus van der Lubbe was, as it happens, schizophrenic and significantly mentally ill. He was not a competent defendant in any legitimate legal system.

Actually, I would argue the evidence suggests van der Lubbe wasn't framed. Just because they were Nazis doesn't mean they were necessarily lying. In more recent years many historians have begun to question the old accepted view that the Nazis burned the Reichstag.

See above. He still was not a competent defendant, and even if the Nazi line were true, would in no way legitimately apologize for the repression of the Left.
