$5 million lawsuit targets Jimmy Carter for ‘attacking Israel’

WASHINGTON – Former President Jimmy Carter has become the target of a class action lawsuit over ostensibly mean things he said about Israel in his best-selling 2006 book, Palestine: Peace Not Apartheid.
The lawsuit, filed in New York by an Israeli firm, alleges that the book "contained numerous false and knowingly misleading statements intended to promote the author's agenda of anti-Israel propaganda and to deceive the reading public instead of presenting accurate information as advertised."
The five American plaintiffs, two of whom are dual citizens of the US and Israel, seek $5 million in damages over the book (which is being sold for less than $10 on Amazon (http://www.amazon.com/Palestine-Peace-Apartheid-Jimmy-Carter/dp/0743285034/?pf_rd_mnb=ATVPDKIKX0D34&pf_rd_stb=center-2&pf_rd_rat=0817NMRY4ZRQZM6P18TH&pf_rd_t3r=101&pf_rd_ptd=470938631&pf_rd_ied=507846&tag=buaazs-20&pf_rd_ptd=470938631&pf_rd_ied=507846)) on the basis that its criticisms of Israel violated consumer protection safeguards.
The plaintiffs alleged in a press release that the 39th US president and Nobel Peace Prize winner "violated the law and, thus, harmed those who purchased the book" by unfairly "attacking Israel."
Attorney Nitsana Darshan-Leitner said her clients' lawsuit "will expose all the falsehoods and misrepresentations in Carter's book and prove that his hatred of Israel has led him to commit this fraud on the public."
Publishing company Simon & Schuster, which is also targeted in the lawsuit, dismissed it as a frivolous act and a "chilling attack on free speech that we intend to defend vigorously."
"This lawsuit is frivolous, without merit, and is a transparent attempt by the plaintiffs, despite their contentions, to punish the author, a Nobel Peace prize winner and world-renowned statesmen, and his publisher, for writing and publishing a book with which the plaintiffs simply disagree," Simon & Schuster spokesman Adam Rothberg told the Washington Post (http://voices.washingtonpost.com/political-bookworm/2011/02/president_carter_named_in_5_mi.html).

This is the reason why an increasing amount of people lose all respect for Israel and Israel supporters.

Criticism of Israel is too often countered with the "hatred for Israel" and ultimately the "anti-semitism" cards to stifle any form of critique and condemnation of Israeli tactics....and completely negates free speech.

Another favorite tactic is the "be fair card". This is the asinine assumption that if you point out the wrongs in Israel you also must point out the wrongs in the Arab and Palestinian side. As if somehow the wrongs of one make right the wrongs you commit.

I hope these people loose their lawsuit. I also hope there will be legal counter measures taken against these people.

lets hope some good information can be gleaned by the public about his book (and the crimes of isreali occupation)in the media war that may occur.

What would be awesome is if this trial of Jimmy Carter worked the way Oscar Wilde's lawsuit did. If you're unfamiliar with it, Oscar Wilde sued the father of a good friend of his for libel, because the man had said that Wilde was a homosexual and he didn't want his son hanging around him. The problem with that is that when you sue someone for libel, you have to prove that what they said isn't true. Well, Oscar Wilde WAS gay and the ensuing investigation humiliated him and put his life on trial, and he ended up tried for sodomy and jailed. His friends had tried to warn him but Wilde was convinced it would turn out alright. Sad story.

It'd be nice though if this Israeli trial turned into the same thing - the defense gets to prove to the courts that the shit Jimmy Carter says is true.

I think even some of the pro-Israel loonies will be embarssed by this. The case will either be thrown out of quickly or will make a mockery of the idea of libel. If anything is pathetic, it was Alan Dershowitz's book that contained several notable mistruths, particularly his alterations of numbers taken from Benny Morris' works.

Something tells me that the people you would reach with this message are not exactly going to be in the market for the services of Israeli lawyers who clearly work closely with the state of Israel.

You might as well boycott rocket ship parts.
