This seems to be the basis on which most of the libertarian right will defend the free market: that we can sue the companies if one affects our civil liberties.
How does one refute these arguments?

How would a private judicial system enforce its verdicts?

The judicial systems would be companies too. So would enforcement companies. There would be better of both for the wealthy (if the poor even have the money to buy in). Why would a private "judicial system" protect your "rights" (other than really wealthy people) any more than a private corporation would right now? Besides, now instead of dominant private dictatorial institutions and one elected-oligarchic system (our governments), you just have widespread private dictatorship. Widespread tyranny.

Companies want profit. They do not want justice, or freedom, or give a humbug about 'civil liberties'. Money's the name of the game for them. Does anyone else smell some serious opportunities for bribes, and influence, and various things that rich people can provide and the working class cannot?
