So anyway, business as usual. Cops are above the law and can assault people at will. And then they tell us that we should uphold cops as outstanding members of society, while making Facebook pages for Raoul Moat is "horrible" (which it is, of course, but that's besides the point).

Obviously, they can't blame any individual for this because the behaviour is an essential part of the British police culture. They are encouraged to hurt people, push them around and brutalise them. It's how they 'keep [us] in line'. Occasionally (there are more than 1000 recorded instances) people die from it. No pig is ever charged, because to condemn one of these murders is to call for a complete overhaul of the policing culture and system in this country. Of course that's what should happen, but the capitalists would never allow that. To them, this murder is just a little more collateral damage of the constant terror which is necessary to maintain (bourgeois) law and order.

If a protester had slam dunked a Copper down who then died a few minutes later from a heart attack, that protester would be in prison on a manslaughter charge within a week.

we all know the story: Tomlinson was walking home through London when approached by a group of police thugs, sorry, officers, one of which hit him from behind with a batton, then shoved him so hard he fell. Shortly afterwards he collapsed and died.

16 months later... The CPS announces that no prosecutions will be brought. (We should be surprised, but we're not)

The police lies and cover up began straight away: they claimed he died of a heart attack, and claimed that they attempted to treat him under a barrage: video evidence proves this to be a lie.

Next they got a dodgy pathologist to carry out a post mortem and he agrees with their assessment. (This pathologist is under investigation over other cases and is likely to be struck off.) But two other pathologists both say that he died of internal bleeding.

Now, because there are conflicting post motrem reports, the CPS says it can't prosecute for manslaughter as the medical evidence is contradictory. How convenient to have a dodgy pathologist on board to muddy the water.

The CPS did say that "there is sufficient evidence to provide a reasonable prospect of proving that the actions of PC 'A' in striking Mr Tomlinson with his baton and then pushing him over constituted an assault. At the time of those acts Mr Tomlinson did not pose a threat … There is sufficient evidence to provide a realistic prospect of proving that his actions were disproportionate and unjustified."

But alas, no action can be taken because the whole process has been dragged on too long: this charge would have had to be brought within 6 months.

Now, who would have known this? You got it: the police, the ICC, the CPS, the State.

But as his stepson says: "They knew that if they dragged this out long enough, they would avoid charges. They knew just what they were doing."

So what we have is a fudge and a cover up.

Just as in the case of Smellie, who plainly assaulted a woman in the same protests, we find that the police can assault, and even kill, ordinary people and then can rely on the machinery of State to protect them, hinder and avoid prosectution, and allow them to continue unscathed.

These are the people who it is claimed act for our protection !!!

Where is the justice for Tomlinson?
Where is the protection for the people from the thugs employed by the State to police us?

It's not there.
This is the State we live in. It cannot be trusted to look after ordinary people.

Well of course; they made no attempt to hide the fact that the officer was not charged because doing so would undermine the state and the police force.

no. why would they charge a protester with manslaughter? no. they would charge them with murder. first degree or whatever equivlent is in uk. and the protester would be convicted of murder.

this is scarletghoul says an example of the system at work. collateral damage.

the state is not afraid to use violence to defend it self. and sometimes it is very obvious and wrong even to those who would defend the states right to violence. but even in those cases (such as this) those who say it is wrong pass it off as isolated. which it isnt.

fuck the state. fuck the government. fuck the police. fuck capitalism.

What amazes me is the way the CPS say "we can't bring charges because it can't be proved whether the fall caused his death".

Surely it is the JURY'S job to decide whether he was killed by the officer, not the CPS. There is more than enough evidence to charge him.

Shameful. Absolutely shameful.

Basically, the police in the UK can kill and injure with de facto impunity. However, this is probably true of most states across the globe. The role of the police in society really couldn't be more odious.

British law allows police to kill protesters if there is no other way of stopping a riot anyway. The bourgeoisie can rewrite and bring in ancient laws that we never knew existed at a moment's notice, this is why we should watch out for others who are vulnerable, who we can help, during any direct action. Someone may have been able to save that man's life, it would not have been pretty but it could have stopped him from being killed, if others had intervened before it was too late.

I know some of the family of Mr. Tomlinson, they were obviously traumatised by the death of Ian, and yet the court systems cant even be bothered to put the murdering bastard who killed him away.

That's the justice system in the UK for you....
