View Full Version : Litigation reform?

The US has the most litigious legal culture in the world, but most other countries' litigation systems have their own features.

Some questions to consider, which are missing from most left platforms:

1) Who are the litigant and parties involved (the state, capitalists, corporations, petit-bourgeois, working poor, etc.)?

2) To what extent should punitive damages apply?

3) Why is litigation not tried by jury?

4) What mechanisms should there be to appropriate the money and transfer it to the litigant in a timely manner? This is because it can take forever these days for a settlement to be paid even before the appeals process.

Thoughts?
