Which countries do not have communist parties? Anybody living in a country with no functioning communist party?

That depends. How big must a group be in order to be considered a party?

America. Instead of a communist party, we have these guys (http://www.cpusa.org/).
More seriously, I believe the communist party is banned in Romania.

The United States practically has no Communist Party. I don't think I've ever encountered the CPUSA on any level in real life. Most of the wacko, sectarian parties have more of a presence in real life.

More seriously, I believe the communist party is banned in Romania.
It is not explicitly banned in the law, but it is banned de facto. The current Romanian constitution has an absurdly vague clause that outlaws all parties which "threaten public order" or something like that. In practice, this has been interpreted by the courts as a ban on communist parties.
Edit - I found the clause in question:
Article 40
"Partidele sau organizaţiile care, prin scopurile ori prin activitatea lor, militează īmpotriva pluralismului politic, a principiilor statului de drept ori a suveranităţii, a integrităţii sau a independenţei Romāniei sunt neconstituţionale."
["Parties and organizations which - in theory or in practice - oppose political pluralism, the rule of law, or the sovereignty, territorial integrity or independence of Romania, are unconstitutional."]
The phrase "in theory or in practice" means that the courts can decide that your party is unconstitutional because it broke one of these rules "in practice", even if the official party program and propaganda does not break any of the rules. So basically the Romanian government can ban any party for any reason, though so far this has only been used against communists.

The United States does'nt have any communist party with any political presence, and honestly, good riddence, the revolution I want does'nt come through a communist party.

What are you talking about. Of course Amerika has a communist parties. It has loads. The OP wasnt asking if any countries have small communist parties, he wants to know if any have no communist parties.
And yeah a few of the eastern european countries have banned communists. Apart from that, I would assume that every other country has communist parties. Except maybe the Vatican.. Theres probably a few other countries who have banned them. Though that doesnt mean they dont exist in some form

Actually, There are alot of countries that literally claim to have banned them, yet actually have reasonable sized ones. For one, I heard that the Czeck Rep. banned the party, then during this post I hear that they have a largish one. I believe Hungary also has one, even though they are also supposed to be banned there.
The same also goes for Poland, Estonia, Latvia, and most other former eastern bloc countries. These states are constantly going on about how everything remotely left-wing is forbidden, yet low and behold, a communist party sudden pops up, with some support.
Saying that, Germany is supposed to have made any Nazi parties illegal, yet they blatantly harbour a rather significant one in the national democrats. Same could also said about the BNP in UK too.
In other words, despite all the tough talk from the bourgois states, it seems that 'bans' are not worth the paper they are printed on.
